77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the parental notification regarding public school
1010 teacher qualifications.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 12A.004(a), Education Code, is amended
1313 to read as follows:
1414 (a) A local innovation plan may not provide for the
1515 exemption of a district designated as a district of innovation from
1616 the following provisions of this title:
1717 (1) a state or federal requirement applicable to an
1818 open-enrollment charter school operating under Subchapter D,
1919 Chapter 12;
2020 (2) Subchapters A, C, D, and E, Chapter 11, except that
2121 a district may be exempt from Sections 11.1511(b)(5) and (14) and
2222 Section 11.162;
2323 (3) state curriculum and graduation requirements
2424 adopted under Chapter 28; [and]
2525 (4) academic and financial accountability and
2626 sanctions under Chapters 39 and 39A; and
2727 (5) parental notification requirements under Section
2828 21.057.
2929 SECTION 2. Sections 21.057(a) and (c), Education Code, are
3030 amended to read as follows:
3131 (a) A school district that assigns an inappropriately
3232 certified or uncertified teacher to the same classroom for more
3333 than 30 consecutive instructional days during the same school year,
3434 excluding the first 30 instructional days of the school year, shall
3535 provide written notice of the assignment to a parent or guardian of
3636 each student in that classroom.
3737 (c) The school district shall:
3838 (1) [make a good-faith effort to] ensure that the
3939 notice required by this section is provided in a bilingual form to
4040 any parent or guardian whose primary language is not English;
4141 (2) retain a copy of any notice provided under this
4242 section; and
4343 (3) make information relating to teacher
4444 certification, including the type of certification held by each
4545 teacher employed by the district, available to the public on the
4646 district's Internet website and on request.
4747 SECTION 3. Section 12A.004(a), Education Code, as amended
4848 by this Act, applies to each local innovation plan adopted under
4949 Chapter 12A, Education Code, regardless of whether the plan was
5050 adopted before, on, or after the effective date of this Act. A local
5151 innovation plan adopted or renewed before the effective date of
5252 this Act must comply with Section 12A.004(a), Education Code, as
5353 amended by this Act, not later than September 1, 2025.
5454 SECTION 4. This Act takes effect September 1, 2025.
