10 | 10 | | teacher qualifications. |

11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 12A.004(a), Education Code, is amended |
---|
13 | 13 | | to read as follows: |
---|
14 | 14 | | (a) A local innovation plan may not provide for the |
---|
15 | 15 | | exemption of a district designated as a district of innovation from |
---|
16 | 16 | | the following provisions of this title: |
---|
17 | 17 | | (1) a state or federal requirement applicable to an |
---|
18 | 18 | | open-enrollment charter school operating under Subchapter D, |
---|
19 | 19 | | Chapter 12; |
---|
20 | 20 | | (2) Subchapters A, C, D, and E, Chapter 11, except that |
---|
21 | 21 | | a district may be exempt from Sections 11.1511(b)(5) and (14) and |
---|
22 | 22 | | Section 11.162; |
---|
23 | 23 | | (3) state curriculum and graduation requirements |
---|
24 | 24 | | adopted under Chapter 28; [and] |
---|
25 | 25 | | (4) academic and financial accountability and |
---|
26 | 26 | | sanctions under Chapters 39 and 39A; and |
---|
27 | 27 | | (5) parental notification requirements under Section |
---|
28 | 28 | | 21.057. |
---|
29 | 29 | | SECTION 2. Sections 21.057(a) and (c), Education Code, are |
---|
30 | 30 | | amended to read as follows: |
---|
31 | 31 | | (a) A school district that assigns an inappropriately |
---|
32 | 32 | | certified or uncertified teacher to the same classroom for more |
---|
33 | 33 | | than 30 consecutive instructional days during the same school year, |
---|
34 | 34 | | excluding the first 30 instructional days of the school year, shall |
---|
35 | 35 | | provide written notice of the assignment to a parent or guardian of |
---|
36 | 36 | | each student in that classroom. |
---|
37 | 37 | | (c) The school district shall: |
---|
38 | 38 | | (1) [make a good-faith effort to] ensure that the |
---|
39 | 39 | | notice required by this section is provided in a bilingual form to |
---|
40 | 40 | | any parent or guardian whose primary language is not English; |
---|
41 | 41 | | (2) retain a copy of any notice provided under this |
---|
42 | 42 | | section; and |
---|
43 | 43 | | (3) make information relating to teacher |
---|
44 | 44 | | certification, including the type of certification held by each |
---|
45 | 45 | | teacher employed by the district, available to the public on the |
---|
46 | 46 | | district's Internet website and on request. |
---|
47 | 47 | | SECTION 3. Section 12A.004(a), Education Code, as amended |
---|
48 | 48 | | by this Act, applies to each local innovation plan adopted under |
---|
49 | 49 | | Chapter 12A, Education Code, regardless of whether the plan was |
---|
50 | 50 | | adopted before, on, or after the effective date of this Act. A local |
---|
51 | 51 | | innovation plan adopted or renewed before the effective date of |
---|
52 | 52 | | this Act must comply with Section 12A.004(a), Education Code, as |
---|
53 | 53 | | amended by this Act, not later than September 1, 2025. |
---|
54 | 54 | | SECTION 4. This Act takes effect September 1, 2025. |
