46 A BILL TO BE ENTITLED
57 AN ACT
68 relating to training requirements for childcare employees and
79 directors.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Section 42.0421, Human Resources Code, is
1012 amended by amending Subsection (f) to read as follows:
1113 (f) The training required by this section must be
1214 appropriately targeted and relevant to the age of the children who
1315 will receive care from the individual receiving training and must
1416 be provided by a Texas independent school district, the Texas
1517 Education Agency, or a person who:
1618 (1) is a training provider registered with the Texas
1719 Early Childhood Professional Development System's Texas Trainer
1820 Registry that is maintained by the Texas Head Start State
1921 Collaboration Office;
2022 (2) is an instructor at a public or private secondary
2123 school, an institution of higher education, as defined by Section
2224 61.003, Education Code, or a private college or university
2325 accredited by a recognized accrediting agency who teaches early
2426 childhood development or another relevant course, as determined by
2527 rules adopted by the commissioner of education and the commissioner
2628 of higher education;
2729 (3) is an employee of a state agency with relevant
2830 expertise;
2931 (4) is a physician, psychologist, licensed
3032 professional counselor, social worker, or registered nurse;
3133 (5) holds a generally recognized credential or
3234 possesses documented knowledge relevant to the training the person
3335 will provide;
3436 (6) is a registered family home care provider or
3537 director of a day-care center or group day-care home in good
3638 standing with the department, if applicable, and who:
3739 (A) has demonstrated core knowledge in child
3840 development and caregiving; and
3941 (B) is only providing training at the home or
4042 center in which the provider or director and the person receiving
4143 training are employed; or
4244 (7) has at least two years of experience working in
4345 child development, a child development program, early childhood
4446 education, a childhood education program, or a Head Start or Early
4547 Head Start program and:
4648 (A) has been awarded a Child Development
4749 Associate (CDA) credential; or
4850 (B) holds at least an associate's degree in child
4951 development, early childhood education, or a related field.
5052 SECTION 2. This Act takes effect immediately if it receives
5153 a vote of two-thirds of all the members elected to each house, as
5254 provided by Section 39, Article III, Texas Constitution. If this
5355 Act does not receive the vote necessary for immediate effect, this
5456 Act takes effect September 1, 2025.
