76 AN ACT
87 relating to the procedure for the dissolution of the Cedar Creek
98 Hospital District and the disposition of district money.
109 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1110 SECTION 1. Section 22, Chapter 22, Acts of the 63rd
1211 Legislature, Regular Session, 1973, is amended to read as follows:
1312 Sec. 22. Except as provided by Sections [Section] 21A(c)
1413 and 21C(c), any election held under this Act shall be in accordance
1514 with the Texas Election Code as it presently exists, and is
1615 hereafter amended and any final court decision or decisions
1716 construing such election code.
1817 SECTION 2. Chapter 22, Acts of the 63rd Legislature,
1918 Regular Session, 1973, is amended by adding Section 21C to read as
2019 follows:
2120 Sec. 21C. (a) The district may be dissolved as provided by
2221 this section only if:
2322 (1) the district is not providing or paying for the
2423 provision of medical or hospital care;
2524 (2) all positions on the board of directors of the
2625 district are vacant;
2726 (3) the district has no outstanding indebtedness; and
2827 (4) the only remaining asset of the district is money.
2928 (b) The county judges of Kaufman, Van Zandt, and Henderson
3029 Counties may jointly agree to order an election on the question of
3130 dissolving the district and using any remaining district money to
3231 establish and administer the scholarship described by Subsection
3332 (g) of this section.
3433 (c) Section 41.001(a), Election Code, does not apply to an
3534 election held under this section.
3635 (d) The ballot for the election shall be printed to permit
3736 voting for or against the proposition: "The dissolution of the
3837 Cedar Creek Hospital District and the use of district money to
3938 establish and administer the Andrew Gibbs Memorial Nursing
4039 Scholarship."
4140 (e) If a majority of the votes cast in the election do not
4241 favor the proposition, the county judges of Kaufman, Van Zandt, and
4342 Henderson Counties may not take any additional action under this
4443 section.
4544 (f) If a majority of the votes cast in the election favor the
4645 proposition:
4746 (1) the county judges of Kaufman, Van Zandt, and
4847 Henderson Counties shall:
4948 (A) find that the district is dissolved; and
5049 (B) transfer the district money in equal shares
5150 to Kaufman, Van Zandt, and Henderson Counties for the purpose of
5251 establishing and administering the Andrew Gibbs Memorial Nursing
5352 Scholarship in accordance with Subsection (g) of this section; and
5453 (2) not later than the 10th day after the date the
5554 commissioners courts of Kaufman, Van Zandt, and Henderson Counties
5655 determine that the requirements of Subdivision (1) of this
5756 subsection have been met, the commissioners courts of the counties
5857 shall enter orders dissolving the district.
5958 (g) The county judges of Kaufman, Van Zandt, and Henderson
6059 Counties shall use the money transferred under Subsection (f) of
6160 this section to jointly establish and administer the Andrew Gibbs
6261 Memorial Nursing Scholarship. The counties shall jointly establish
6362 an oversight committee to administer the scholarship. The
6463 oversight committee may establish eligibility criteria and
6564 procedures for the application and selection process, provided that
6665 the eligibility criteria must require an individual receiving a
6766 scholarship to:
6867 (1) reside in the boundaries of the district, as those
6968 boundaries existed on the date of the election described by
7069 Subsection (b) of this section, at the time the individual is
7170 accepted for admission to a nursing education program at an
7271 institution of higher education in this state; and
7372 (2) be currently enrolled in, or have been accepted
7473 for admission to, a nursing education program described by
7574 Subdivision (1) of this subsection.
76- (h) The county judges and the oversight committee
77- established under Subsection (g) may collaborate with an
78- institution of higher education, as defined by Section 61.003,
79- Education Code, located in the boundaries of the district as
80- described by Subsection (g) for the purposes of establishing and
81- administering the scholarship.
8275 SECTION 3. This Act takes effect immediately if it receives
8376 a vote of two-thirds of all the members elected to each house, as
8477 provided by Section 39, Article III, Texas Constitution. If this
8578 Act does not receive the vote necessary for immediate effect, this
8679 Act takes effect September 1, 2025.
