10 | 10 | | certain gender transitioning or gender reassignment procedures or |

11 | 11 | | treatments to that child; creating a criminal offense. |

12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 13 | | SECTION 1. Subchapter X, Chapter 161, Health and Safety |
---|
14 | 14 | | Code, as added by Chapter 335 (S.B. 14), Acts of the 88th |
---|
15 | 15 | | Legislature, Regular Session, 2023, is amended by adding Section |
---|
16 | 16 | | 161.707 to read as follows: |
---|
17 | 17 | | Sec. 161.707. CRIMINAL OFFENSE. (a) A person commits an |
---|
18 | 18 | | offense if the person travels from this state to a location outside |
---|
19 | 19 | | this state with a child who is a resident of this state to |
---|
20 | 20 | | facilitate the child's ability to receive a procedure or treatment |
---|
21 | 21 | | that would otherwise be prohibited by Section 161.702 if the |
---|
22 | 22 | | procedure or treatment occurred in this state. |
---|
23 | 23 | | (b) It is an exception to the application of this section |
---|
24 | 24 | | that the conduct occurred solely to enable the child to receive a |
---|
25 | 25 | | procedure or treatment that is authorized under Section 161.703. |
---|
26 | 26 | | (c) An offense under this section is a felony of the first |
---|
27 | 27 | | degree. |
---|
28 | 28 | | SECTION 2. It is the intent of the 89th Legislature, Regular |
---|
29 | 29 | | Session, 2025, that the amendments made by this Act to Subchapter X, |
---|
30 | 30 | | Chapter 161, Health and Safety Code, be harmonized with another Act |
---|
31 | 31 | | of the 89th Legislature, Regular Session, 2025, relating to |
---|
32 | 32 | | nonsubstantive additions to and corrections in enacted codes. |
---|
33 | 33 | | SECTION 3. This Act takes effect September 1, 2025. |
