77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to traveling with a child to facilitate the provision of
1010 certain gender transitioning or gender reassignment procedures or
1111 treatments to that child; creating a criminal offense.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter X, Chapter 161, Health and Safety
1414 Code, as added by Chapter 335 (S.B. 14), Acts of the 88th
1515 Legislature, Regular Session, 2023, is amended by adding Section
1616 161.707 to read as follows:
1717 Sec. 161.707. CRIMINAL OFFENSE. (a) A person commits an
1818 offense if the person travels from this state to a location outside
1919 this state with a child who is a resident of this state to
2020 facilitate the child's ability to receive a procedure or treatment
2121 that would otherwise be prohibited by Section 161.702 if the
2222 procedure or treatment occurred in this state.
2323 (b) It is an exception to the application of this section
2424 that the conduct occurred solely to enable the child to receive a
2525 procedure or treatment that is authorized under Section 161.703.
2626 (c) An offense under this section is a felony of the first
2727 degree.
2828 SECTION 2. It is the intent of the 89th Legislature, Regular
2929 Session, 2025, that the amendments made by this Act to Subchapter X,
3030 Chapter 161, Health and Safety Code, be harmonized with another Act
3131 of the 89th Legislature, Regular Session, 2025, relating to
3232 nonsubstantive additions to and corrections in enacted codes.
3333 SECTION 3. This Act takes effect September 1, 2025.
