88 AN ACT
99 relating to the establishment and administration of the Texas
1010 Quantum Initiative.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 481, Government Code, is amended by
1313 adding Subchapter HH to read as follows:
1414 SUBCHAPTER HH. TEXAS QUANTUM INITIATIVE
1515 Sec. 481.681. DEFINITIONS. In this subchapter:
1616 (1) "Executive committee" means the executive
1717 committee of the initiative.
1818 (2) "Initiative" means the Texas Quantum Initiative.
1919 (3) "Institution of higher education" has the meaning
2020 assigned by Section 61.003, Education Code.
2121 Sec. 481.682. ESTABLISHMENT; PURPOSES. (a) The Texas
2222 Quantum Initiative is established to:
2323 (1) establish and advance this state's position as a
2424 national leader in the quantum industry; and
2525 (2) accelerate the integration of quantum computing,
2626 networking, and sensing technology into the economy of this state.
2727 (b) The purposes of the initiative are to:
2828 (1) leverage the expertise and capacity of regulatory
2929 stakeholders and institutions of higher education and industry to
3030 develop a comprehensive strategic plan to ensure the development of
3131 quantum technologies in this state;
3232 (2) identify obstacles and provide recommendations to
3333 the governor and legislature regarding quantum economic
3434 opportunities and technologies;
3535 (3) provide strategic leadership with respect to
3636 quantum initiatives;
3737 (4) identify and expand opportunities for workforce
3838 training and development related to the research, design, and
3939 manufacturing of quantum computing technology;
4040 (5) support existing quantum computing and networking
4141 industries in this state;
4242 (6) attract new quantum computing and networking
4343 projects and partners to this state;
4444 (7) support the development of a quantum manufacturing
4545 supply chain in this state; and
4646 (8) develop a comprehensive strategic plan for the
4747 state to ensure ongoing quantum leadership, prioritizing
4848 commercial and practical utility, through investments in the
4949 necessary foundational infrastructure, including quantum systems
5050 and networking equipment, jobs and workforce, and real property.
5151 Sec. 481.683. ADMINISTRATIVE ATTACHMENT. (a) The
5252 initiative is administratively attached to the office of the
5353 governor.
5454 (b) The office of the governor shall provide the staff and
5555 facilities necessary to assist the initiative in performing the
5656 initiative's duties under this subchapter.
5757 Sec. 481.684. EXECUTIVE COMMITTEE COMPOSITION. (a) The
5858 initiative is governed by an executive committee composed of the
5959 following members:
6060 (1) three members appointed by the governor;
6161 (2) two members appointed by the lieutenant governor;
6262 and
6363 (3) two members appointed by the speaker of the house
6464 of representatives.
6565 (b) In making appointments under Subsection (a), priority
6666 shall be given to individuals from the quantum design and
6767 manufacturing sectors.
6868 (c) In making appointments under Subsection (a), the
6969 governor, the lieutenant governor, and the speaker of the house of
7070 representatives shall coordinate to ensure that the members of the
7171 executive committee include:
7272 (1) at least one representative from a quantum
7373 infrastructure provider who has demonstrated experience in:
7474 (A) implementing quantum networks in similar
7575 settings; and
7676 (B) deploying leading edge quantum computing
7777 systems in third-party data centers; and
7878 (2) at least one representative of a manufacturer of a
7979 quantum computing system with the ability to enable the creation
8080 and deployment of quantum solutions with commercial and practical
8181 use.
8282 (d) An executive committee member serves a two-year term.
8383 An executive committee member may be reappointed for additional
8484 terms.
8585 (e) A vacancy on the executive committee shall be filled by
8686 appointment. The authority that appointed the former member of the
8787 vacant position shall appoint a new member to the vacant position.
8888 (f) Initial executive committee appointments shall be made
8989 by October 1, 2025. This subsection expires December 31, 2025.
9090 Sec. 481.685. EXECUTIVE DIRECTOR. (a) The executive
9191 committee shall hire an executive director. The executive director
9292 shall perform the duties required by this subchapter and any duty
9393 delegated by the committee.
9494 (b) The executive director must have demonstrated an
9595 ability to lead and develop academic, commercial, or governmental
9696 partnerships and coalitions.
9797 (c) The executive director may hire staff as necessary to
9898 implement the duties of the initiative under this subchapter.
9999 Sec. 481.686. DUTIES OF EXECUTIVE COMMITTEE. The executive
100100 committee shall:
101101 (1) develop and execute a comprehensive statewide
102102 strategic plan to further the purposes of the initiative under
103103 Section 481.682;
104104 (2) solicit recommendations from institutions of
105105 higher education, initiative members, and stakeholders on funding
106106 and research opportunities related to quantum education and
107107 research, design, commercialization, community outreach, and
108108 manufacturing projects;
109109 (3) appoint and determine the salary for an executive
110110 director as hired under Section 481.685;
111111 (4) administer funds, including any funds
112112 appropriated by the legislature or available under Section 481.689,
113113 to support quantum design and manufacturing, capital projects,
114114 supply chain development, and other initiatives; and
115115 (5) prepare and submit the report required by Section
116116 481.688.
117117 Sec. 481.687. STRATEGIC PLAN. (a) The executive committee
118118 shall develop a strategic plan for the promotion of the quantum
119119 economy in this state. The plan must include:
120120 (1) a list of potential projects that further the
121121 goals of the initiative;
122122 (2) a list of federal grant opportunities that are
123123 related to quantum technology and for which institutions in this
124124 state are eligible to apply;
125125 (3) an assessment of the availability of external
126126 funding sources for each project identified under Subdivision (1);
127127 and
128128 (4) any other information the executive committee
129129 determines is relevant to further the initiative's goals.
130130 (b) The executive committee shall submit the strategic plan
131131 required by this section not later than December 31 of each year to
132132 the governor, the lieutenant governor, and the speaker of the house
133133 of representatives.
134134 Sec. 481.688. BIENNIAL REPORT. Not later than December 1 of
135135 each even-numbered year, the executive committee shall prepare and
136136 submit to the governor and the Legislative Budget Board a written
137137 report that outlines:
138138 (1) activities undertaken to meet the purposes of the
139139 initiative under Section 481.682;
140140 (2) a summary of the funding and research
141141 opportunities identified by the executive committee;
142142 (3) any legislative recommendations to further the
143143 purposes of the initiative;
144144 (4) any prospective grants or funding the initiative
145145 members expect to apply for or receive; and
146146 (5) any research accomplishments associated with the
147147 initiative.
148148 Sec. 481.689. QUANTUM UNIVERSITY AND BUSINESS INNOVATION
149149 FOR TEXAS FUND. (a) In this section, "fund" means the Quantum
150150 University and Business Innovation for Texas Fund created by this
151151 section.
152152 (b) The Quantum University and Business Innovation for
153153 Texas Fund is created as a dedicated account within the general
154154 revenue fund. The fund consists of:
155155 (1) gifts, grants, or donations to the fund; and
156156 (2) money from any other source designated by the
157157 legislature.
158158 (c) Money in the fund may be used to:
159159 (1) provide matching funding to state entities,
160160 including institutions of higher education, for quantum
161161 manufacturing and design projects;
162162 (2) award grants to business entities to encourage
163163 economic development related to quantum manufacturing and design
164164 projects; and
165165 (3) subject to Subsection (d), pay for staff support
166166 services described by Section 481.685(c).
167167 (d) The executive committee shall request approval from the
168168 Legislative Budget Board to use money in the fund for the purpose
169169 described by Subsection (c)(3). A request under this subsection is
170170 considered approved on the 30th day after receipt by the
171171 Legislative Budget Board unless expressly denied.
172172 SECTION 2. This Act takes effect September 1, 2025.
