88 AN ACT
99 relating to a report on governmental opioid antagonist programs to
1010 reverse and prevent opioid overdoses.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter B, Chapter 461A, Health and Safety
1313 Code, is amended by adding Section 461A.060 to read as follows:
1414 Sec. 461A.060. BIENNIAL REPORT ON OPIOID ANTAGONIST
1515 PROGRAMS FOR OPIOID OVERDOSE REVERSAL AND PREVENTION. (a) In this
1616 section, "opioid antagonist" has the meaning assigned by Section
1717 483.101.
1818 (b) Not later than October 1 of each even-numbered year, the
1919 commission shall:
2020 (1) prepare a report evaluating the distribution of
2121 opioid antagonists in this state to reverse and prevent opioid
2222 overdoses; and
2323 (2) submit the report to the governor, the lieutenant
2424 governor, and the speaker of the house of representatives.
2525 (c) The report described by Subsection (b) must:
2626 (1) include a needs assessment for the opioid
2727 antagonist program established under Section 461A.059;
2828 (2) establish a statewide saturation goal for opioid
2929 antagonists and include:
3030 (A) a description of the data sources and
3131 methodology used to estimate insufficiencies in the current supply
3232 of opioid antagonists; and
3333 (B) a communications plan to address opioid
3434 overdoses in areas of this state at higher risk for increased
3535 numbers of overdoses;
3636 (3) include a description of all state and federal
3737 money appropriated to the opioid antagonist program established
3838 under Section 461A.059;
3939 (4) establish opioid antagonist distribution
4040 strategies for this state;
4141 (5) list and describe all available state and
4242 federally funded purchase and distribution programs for opioid
4343 antagonists; and
4444 (6) recommend improvements for addressing opioid
4545 overdoses among high-risk populations, including school-aged
4646 children, pregnant and postpartum women, and individuals residing
4747 in rural areas of this state.
4848 (d) In preparing the report under this section, the
4949 commission shall coordinate and consult with each state agency,
5050 institution of higher education, and political subdivision of this
5151 state that receives funding or other resources under Section
5252 461A.059 for the distribution of opioid antagonists.
5353 SECTION 2. This Act takes effect September 1, 2025.
