77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a study by the Department of State Health Services
1010 regarding the effects of online activity on children.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. (a) In this section:
1313 (1) "Child" means an individual who is younger than 18
1414 years of age.
1515 (2) "Department" means the Department of State Health
1616 Services.
1717 (b) The department, in collaboration with the Texas
1818 Education Agency, shall conduct a study to assess the short-term
1919 and long-term effects of online activity on a child's well-being.
2020 (c) In conducting the study, the department shall:
2121 (1) define the term "digital well-being" in the
2222 context of children engaging in online activity;
2323 (2) identify the desired positive outcomes for
2424 children engaging in online activity and develop recommendations
2525 for achieving those positive outcomes;
2626 (3) identify and examine:
2727 (A) the types of online activity that children
2828 engage in that correspond with different digital well-being
2929 outcomes, including an analysis of the content of the online
3030 activity; and
3131 (B) recommendations from public and private
3232 institutions for best practices for ensuring children's online
3333 activity is safe and healthy; and
3434 (4) solicit feedback from children and children's
3535 parents or legal guardians regarding specific harms that children
3636 have experienced as a result of engaging in online activity.
3737 (d) Not later than December 1, 2027, the department shall
3838 submit to the governor, the lieutenant governor, the speaker of the
3939 house of representatives, and the commissioner of the department a
4040 written report that:
4141 (1) summarizes the results of the study conducted
4242 under this section; and
4343 (2) includes recommendations for legislative or other
4444 action.
4545 SECTION 2. This Act expires January 1, 2028.
4646 SECTION 3. This Act takes effect immediately if it receives
4747 a vote of two-thirds of all the members elected to each house, as
4848 provided by Section 39, Article III, Texas Constitution. If this
4949 Act does not receive the vote necessary for immediate effect, this
5050 Act takes effect September 1, 2025.
