Wilson, Chair, House Committee on Higher Education     FROM: Jerry McGinty, Director, Legislative Budget Board      IN RE: HB5265 by Wilson (Relating to the health care professional education fund.), As Introduced     No significant fiscal implication to the State is anticipated; however, there could be a fiscal impact dependent on an appropriation of funds for transfer and deposit to the new Health Care Professional Education Fund. Contingent on the passage of House Joint Resolution 203, the bill would establish the Health Care Professional Education Fund (fund) as a fund outside the state treasury held by the Comptroller of Public Accounts and administered by the Texas Treasury Safekeeping Trust Company (TTSTC).The bill would require TTSTC to determine the amount available for distribution from the fund in accordance with policy adopted by the Comptroller. The bill would allow the Comptroller to solicit and accept gifts, grants, or donations from any public or private source for the fund. The total amount appropriated from the fund for any fiscal year must not exceed 7.0 percent of the average net market value of the investment assets of the fund.The bill would require that, of the amount appropriated from the fund for distribution in a fiscal year, 95.0 percent be allocated to the permanent endowment for health care professional education to be distributed to eligible institutions based on a formula set forth in the bill, and 5.0 percent be allocated to the health care professional education startup fund to be distributed by the Texas Higher Education Coordinating Board (THECB).The bill would authorize eligible institutions to use distributions from the fund only for the support and maintenance of educational and general activities that promote increased capacity to award health care professional degrees in a manner that aligns with the goals of the state's master plan for higher education.The bill would require the Legislative Budget Board, in consultation with THECB, to determine the amounts to be distributed to each eligible institution and report the determinations to the Legislature and the Comptroller.Note: This legislation would do one or more of the following: create or recreate a dedicated account in the General Revenue Fund, create or recreate a special or trust fund either in, with, or outside the Treasury, or create a dedicated revenue source. The fund, account, or revenue dedication included in this bill would be subject to funds consolidation review by the current Legislature.
