77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to medical school admissions, coursework, academic
1010 standards, and employment decisions in this state.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter F, Chapter 51, Education Code, is
1313 amended by adding Section 51.3095 to read as follows:
1414 Sec. 51.3095. CERTAIN REQUIREMENTS FOR MEDICAL EDUCATION
1515 COURSEWORK AND ACADEMIC STANDARDS REVISIONS. (a) In this section,
1616 "medical school" means:
1717 (1) a medical school as defined by Section 61.501; or
1818 (2) any other institution of higher education, as
1919 defined by Section 61.003, or school, department, or college of
2020 such an institution, that awards medical degrees.
2121 (b) Each medical school:
2222 (1) shall ensure that any coursework offered in the
2323 curriculum required for a medical degree or certificate assesses a
2424 student's performance on the coursework based on the assignment of
2525 a letter grade from A to F; and
2626 (2) may not offer coursework described by Subdivision
2727 (1), including any assignment or other component of the coursework,
2828 on a pass/fail basis.
2929 (c) Except as required to comply with state or federal law,
3030 a medical school may not revise its academic standards for the award
3131 of a degree or certificate unless the medical school submits to the
3232 legislature and the Texas Higher Education Coordinating Board:
3333 (1) a copy of the proposed standards;
3434 (2) a concise general statement of the reasons for the
3535 proposed standards; and
3636 (3) the date on which the proposed standards would
3737 become effective.
3838 SECTION 2. Subchapter W, Chapter 51, Education Code, is
3939 amended by adding Section 51.8425 to read as follows:
4040 Sec. 51.8425. CERTAIN REQUIREMENTS RELATING TO MEDICAL
4141 SCHOOL ADMISSION. (a) In this section, "medical school" has the
4242 meaning assigned by Section 51.3095.
4343 (b) In making admissions decisions for a medical degree or
4444 certificate program, a medical school shall consider an applicant's
4545 performance on a standardized test appropriate for the program that
4646 focuses on knowledge of and critical thinking applicable to science
4747 and medical practice, except that the applicant's performance on
4848 the standardized test may not be used as the sole criterion for
4949 consideration of the applicant.
5050 (c) Except as required to comply with state or federal law,
5151 a medical school may not revise its academic standards for the
5252 admission of a student to the medical school or to a degree or
5353 certificate program unless the medical school submits to the
5454 legislature and the Texas Higher Education Coordinating Board:
5555 (1) a copy of the proposed standards;
5656 (2) a concise general statement of the reasons for the
5757 proposed standards; and
5858 (3) the date on which the proposed standards would
5959 become effective.
6060 SECTION 3. Subchapter Z, Chapter 51, Education Code, is
6161 amended by adding Section 51.9247 to read as follows:
6262 Sec. 51.9247. CONSIDERATION OF RACE, SEX, COLOR, ETHNICITY,
6363 OR NATIONAL ORIGIN IN MEDICAL SCHOOL ADMISSIONS AND EMPLOYMENT
6464 DECISIONS PROHIBITED. (a) In this section, "medical school" has
6565 the meaning assigned by Section 51.3095.
6666 (b) Notwithstanding any other provision of law, a medical
6767 school may not grant preference on the basis of race, sex, color,
6868 ethnicity, or national origin to an applicant:
6969 (1) for admission to the medical school or to a degree
7070 or certificate program; or
7171 (2) for employment by the medical school.
7272 (c) Nothing in this section may be construed as prohibiting
7373 bona fide qualifications based on sex that are reasonably necessary
7474 to the normal operation of a medical school.
7575 SECTION 4. The changes in law made by this Act to admissions
7676 at medical schools apply beginning with admissions for the 2026
7777 spring semester. Admissions for an academic period preceding that
7878 semester are governed by the law in effect immediately before the
7979 effective date of this Act, and the former law is continued in
8080 effect for that purpose.
8181 SECTION 5. This Act takes effect immediately if it receives
8282 a vote of two-thirds of all the members elected to each house, as
8383 provided by Section 39, Article III, Texas Constitution. If this
8484 Act does not receive the vote necessary for immediate effect, this
8585 Act takes effect September 1, 2025.
