77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the permissible uses of the school safety allotment and
1010 the creation of a mental and behavioral health allotment under the
1111 Foundation School Program.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 48.115(b), Education Code, is amended to
1414 read as follows:
1515 (b) Funds allocated under this section must be used to
1616 improve school safety and security, including costs associated
1717 with:
1818 (1) securing school facilities in accordance with the
1919 requirements of Section 37.351, including:
2020 (A) improvements to school infrastructure;
2121 (B) the use or installation of perimeter security
2222 fencing conducive to a public school learning environment or
2323 physical barriers, which may not include razor wire;
2424 (C) exterior door and window safety and security
2525 upgrades, including exterior door numbering and locking systems and
2626 security film that provides resistance to a forced entry; and
2727 (D) the purchase and maintenance of:
2828 (i) security cameras and, if the district
2929 has already installed security cameras, other security equipment,
3030 including video surveillance as provided by Section 29.022; and
3131 (ii) technology, including communications
3232 systems or devices, such as silent panic alert devices, two-way
3333 radios, or wireless Internet booster equipment, that facilitates
3434 communication and information sharing between students, school
3535 personnel, and first responders in an emergency;
3636 (2) providing security for the district, including:
3737 (A) employing school district peace officers,
3838 private security officers, and school marshals; and
3939 (B) collaborating with local law enforcement
4040 agencies, such as entering into a memorandum of understanding for
4141 the assignment of school resource officers to schools in the
4242 district;
4343 (3) school safety and security measures, including:
4444 (A) active shooter and emergency response
4545 training;
4646 (B) prevention and treatment programs relating
4747 to addressing adverse childhood experiences; and
4848 (C) the prevention, identification, and
4949 management of emergencies and threats, using evidence-based,
5050 effective prevention practices and including the establishment of
5151 [:
5252 [(i) providing licensed counselors, social
5353 workers, chaplains, and individuals trained in restorative
5454 discipline and restorative justice practices;
5555 [(ii) providing mental health personnel and
5656 support, including chaplains;
5757 [(iii) providing behavioral health
5858 services, including services provided by chaplains;
5959 [(iv) establishing] threat detection and
6060 reporting systems; and
6161 [(v) developing and implementing programs
6262 focused on restorative justice practices, culturally relevant
6363 instruction, and providing mental health support, including
6464 support provided by chaplains;]
6565 (4) [providing programs related to suicide
6666 prevention, intervention, and postvention, including programs
6767 provided by chaplains; and
6868 [(5)] employing a school safety director and other
6969 personnel to manage and monitor school safety initiatives and the
7070 implementation of school safety requirements for the district.
7171 SECTION 2. Subchapter C, Chapter 48, Education Code, is
7272 amended by adding Section 48.117 to read as follows:
7373 Sec. 48.117. MENTAL HEALTH ALLOTMENT. (a) A school
7474 district is entitled to an annual allotment to support mental
7575 health services at the district in an amount of:
7676 (1) $100,000 for a school district with 1,000 or fewer
7777 students; or
7878 (2) $100 for each enrolled student for a school
7979 district with more than 1,000 students.
8080 (b) Funds allocated under this section:
8181 (1) must be used to develop or enhance a comprehensive
8282 school mental health system that, through the implementation of
8383 programs, practices, and procedures in accordance with Section
8484 38.351, provides a tiered array of supports and services in the
8585 educational setting that contribute to:
8686 (A) a positive school climate;
8787 (B) the development of skills related to managing
8888 emotions, establishing and maintaining positive relationships, and
8989 responsible decision-making;
9090 (C) the learning and well-being of students with
9191 or at risk of mental health or substance use conditions;
9292 (D) family and community engagement;
9393 (E) reduced exclusionary discipline practices;
9494 and
9595 (F) staff wellness;
9696 (2) may be used to pay for costs associated with:
9797 (A) the salary of school personnel responsible
9898 for planning, coordinating, delivering, or monitoring supports and
9999 services described by Subdivision (1);
100100 (B) training school personnel regarding
101101 effective practices and district and campus procedures to support
102102 student mental health;
103103 (C) a contract-based collaborative effort or
104104 partnership with one or more local community programs, agencies, or
105105 providers; and
106106 (D) developing and implementing programs focused
107107 on restorative justice practices; and
108108 (3) must be allocated in coordination with school
109109 counselors, social workers, and other individuals trained to
110110 provide mental health support and behavioral health services.
111111 (c) Funds allocated for purposes of this section may not be
112112 used to supplant any other funds that may be provided for the same
113113 purpose.
114114 (d) Not later than June 1 of each year and in accordance with
115115 commissioner rule, each school district shall submit to the
116116 commissioner information regarding the outcomes and expenditures
117117 related to funds allocated to the district under this section.
118118 (e) Not later than September 1 of each year, the
119119 commissioner shall publish a report regarding the use of funds
120120 allocated under this section during the preceding school year,
121121 including information regarding the programs, personnel, and
122122 resources implemented, employed, or purchased by school districts
123123 using the funds and other purposes for which the funds were used.
124124 SECTION 3. This Act takes effect September 1, 2025.
