| 9 | 9 | | relating to the selection, prioritization, and funding of |
|---|
| 10 | 10 | | transportation projects. |
|---|
| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 201.601(d), Transportation Code, is |
|---|
| 13 | 13 | | amended to read as follows: |
|---|
| 14 | 14 | | (d) In selecting transportation projects, the department |
|---|
| 15 | 15 | | shall: |
|---|
| 16 | 16 | | (1) prioritize projects identified under Section |
|---|
| 17 | 17 | | 201.991(a)(3); and |
|---|
| 18 | 18 | | (2) consider the transportation system strategies, |
|---|
| 19 | 19 | | goals and measurable targets, and other related performance |
|---|
| 20 | 20 | | measures established under Subsection (a-1)(1). |
|---|
| 21 | 21 | | SECTION 2. Section 201.609, Transportation Code, is amended |
|---|
| 22 | 22 | | to read as follows: |
|---|
| 23 | 23 | | Sec. 201.609. NOTICE TO LEGISLATORS OF CERTAIN ACTIONS |
|---|
| 24 | 24 | | [COMPLETED PROJECTS]. [(a)] Not later than the 10th day after the |
|---|
| 25 | 25 | | date a major road project is selected for funding or the 10th day |
|---|
| 26 | 26 | | before the date on which a major road project is scheduled for |
|---|
| 27 | 27 | | completion, as applicable, the department shall provide notice [of |
|---|
| 28 | 28 | | the location and completion date of the road project] to each member |
|---|
| 29 | 29 | | of the legislature who represents the county in which the road |
|---|
| 30 | 30 | | project is located of: |
|---|
| 31 | 31 | | (1) the selection of the road project for funding; or |
|---|
| 32 | 32 | | (2) the completion of the project [and who wants to |
|---|
| 33 | 33 | | receive the notice]. |
|---|
| 34 | 34 | | [(b) The department shall ask each legislator whether the |
|---|
| 35 | 35 | | legislator wants to receive notices under this section.] |
|---|
| 36 | 36 | | SECTION 3. Section 201.808(e), Transportation Code, is |
|---|
| 37 | 37 | | amended to read as follows: |
|---|
| 38 | 38 | | (e) The department shall establish criteria to prioritize |
|---|
| 39 | 39 | | the transportation needs for the state that are consistent with the |
|---|
| 40 | 40 | | statewide transportation plan. In establishing prioritization |
|---|
| 41 | 41 | | criteria under this subsection the department shall ensure that |
|---|
| 42 | 42 | | transportation expenditures are split evenly between: |
|---|
| 43 | 43 | | (1) transportation projects that are required to |
|---|
| 44 | 44 | | maintain the state infrastructure; and |
|---|
| 45 | 45 | | (2) transportation projects that would improve the |
|---|
| 46 | 46 | | state infrastructure. |
|---|
| 47 | 47 | | SECTION 4. Section 201.991(a), Transportation Code, is |
|---|
| 48 | 48 | | amended to read as follows: |
|---|
| 49 | 49 | | (a) The department shall develop a unified transportation |
|---|
| 50 | 50 | | program covering a period of 10 years to guide the development of |
|---|
| 51 | 51 | | and authorize construction of transportation projects. The |
|---|
| 52 | 52 | | program must: |
|---|
| 53 | 53 | | (1) annually identify target funding levels; [and] |
|---|
| 54 | 54 | | (2) list all projects that the department intends to |
|---|
| 55 | 55 | | develop or begin construction of during the program period; and |
|---|
| 56 | 56 | | (3) identify and prioritize transportation projects |
|---|
| 57 | 57 | | that: |
|---|
| 58 | 58 | | (A) are required to maintain the state |
|---|
| 59 | 59 | | infrastructure; or |
|---|
| 60 | 60 | | (B) would improve the state infrastructure. |
|---|
| 61 | 61 | | SECTION 5. This Act takes effect September 1, 2025. |
