77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the selection, prioritization, and funding of
1010 transportation projects.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 201.601(d), Transportation Code, is
1313 amended to read as follows:
1414 (d) In selecting transportation projects, the department
1515 shall:
1616 (1) prioritize projects identified under Section
1717 201.991(a)(3); and
1818 (2) consider the transportation system strategies,
1919 goals and measurable targets, and other related performance
2020 measures established under Subsection (a-1)(1).
2121 SECTION 2. Section 201.609, Transportation Code, is amended
2222 to read as follows:
2323 Sec. 201.609. NOTICE TO LEGISLATORS OF CERTAIN ACTIONS
2424 [COMPLETED PROJECTS]. [(a)] Not later than the 10th day after the
2525 date a major road project is selected for funding or the 10th day
2626 before the date on which a major road project is scheduled for
2727 completion, as applicable, the department shall provide notice [of
2828 the location and completion date of the road project] to each member
2929 of the legislature who represents the county in which the road
3030 project is located of:
3131 (1) the selection of the road project for funding; or
3232 (2) the completion of the project [and who wants to
3333 receive the notice].
3434 [(b) The department shall ask each legislator whether the
3535 legislator wants to receive notices under this section.]
3636 SECTION 3. Section 201.808(e), Transportation Code, is
3737 amended to read as follows:
3838 (e) The department shall establish criteria to prioritize
3939 the transportation needs for the state that are consistent with the
4040 statewide transportation plan. In establishing prioritization
4141 criteria under this subsection the department shall ensure that
4242 transportation expenditures are split evenly between:
4343 (1) transportation projects that are required to
4444 maintain the state infrastructure; and
4545 (2) transportation projects that would improve the
4646 state infrastructure.
4747 SECTION 4. Section 201.991(a), Transportation Code, is
4848 amended to read as follows:
4949 (a) The department shall develop a unified transportation
5050 program covering a period of 10 years to guide the development of
5151 and authorize construction of transportation projects. The
5252 program must:
5353 (1) annually identify target funding levels; [and]
5454 (2) list all projects that the department intends to
5555 develop or begin construction of during the program period; and
5656 (3) identify and prioritize transportation projects
5757 that:
5858 (A) are required to maintain the state
5959 infrastructure; or
6060 (B) would improve the state infrastructure.
6161 SECTION 5. This Act takes effect September 1, 2025.
