89R18912 JAM-D By: Craddick H.B. No. 5453 A BILL TO BE ENTITLED AN ACT relating to the selection, prioritization, and funding of transportation projects. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 201.601(d), Transportation Code, is amended to read as follows: (d) In selecting transportation projects, the department shall: (1) prioritize projects identified under Section 201.991(a)(3); and (2) consider the transportation system strategies, goals and measurable targets, and other related performance measures established under Subsection (a-1)(1). SECTION 2. Section 201.609, Transportation Code, is amended to read as follows: Sec. 201.609. NOTICE TO LEGISLATORS OF CERTAIN ACTIONS [COMPLETED PROJECTS]. [(a)] Not later than the 10th day after the date a major road project is selected for funding or the 10th day before the date on which a major road project is scheduled for completion, as applicable, the department shall provide notice [of the location and completion date of the road project] to each member of the legislature who represents the county in which the road project is located of: (1) the selection of the road project for funding; or (2) the completion of the project [and who wants to receive the notice]. [(b) The department shall ask each legislator whether the legislator wants to receive notices under this section.] SECTION 3. Section 201.808(e), Transportation Code, is amended to read as follows: (e) The department shall establish criteria to prioritize the transportation needs for the state that are consistent with the statewide transportation plan. In establishing prioritization criteria under this subsection the department shall ensure that transportation expenditures are split evenly between: (1) transportation projects that are required to maintain the state infrastructure; and (2) transportation projects that would improve the state infrastructure. SECTION 4. Section 201.991(a), Transportation Code, is amended to read as follows: (a) The department shall develop a unified transportation program covering a period of 10 years to guide the development of and authorize construction of transportation projects. The program must: (1) annually identify target funding levels; [and] (2) list all projects that the department intends to develop or begin construction of during the program period; and (3) identify and prioritize transportation projects that: (A) are required to maintain the state infrastructure; or (B) would improve the state infrastructure. SECTION 5. This Act takes effect September 1, 2025.
