6 | 8 | | relating to the abolishment, creation, and re-creation of reports. |

7 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 10 | | SECTION 1. DEFINITION. In this Act "report" means an ad hoc |
---|
9 | 11 | | or periodic publication, study, compilation of information, |
---|
10 | 12 | | statement or written work product produced by an agency in the |
---|
11 | 13 | | executive or judicial branch of state government for distribution |
---|
12 | 14 | | to the legislature or an agency in the legislative branch of state |
---|
13 | 15 | | government and includes reports that are also for distribution to |
---|
14 | 16 | | an officer or agency in the executive branch of state government. |
---|
15 | 17 | | SECTION 2. ABOLITION OF REPORTS. Except as otherwise |
---|
16 | 18 | | specifically provided by this Act, all reports created by law |
---|
17 | 19 | | enacted or re-enacted by an Act of the 89th Legislature, Regular |
---|
18 | 20 | | Session, 2025, that becomes law are abolished on the later of August |
---|
19 | 21 | | 31, 2025, or the date the Act creating the report takes effect. |
---|
20 | 22 | | SECTION 3. PREVIOUSLY EXEMPT REPORTS; CONSTITUTIONAL |
---|
21 | 23 | | REPORTS. Section 2 of this Act does not apply to reports that were |
---|
22 | 24 | | created by law enacted before the 89th Legislature convened, or to |
---|
23 | 25 | | reports required by state constitutional law. |
---|
24 | 26 | | SECTION 4. FEDERAL REPORTS. Section 2 of this Act does not |
---|
25 | 27 | | apply to reports created under an Act of the 89th Legislature, |
---|
26 | 28 | | Regular Session, 2025, for which the report is required by federal |
---|
27 | 29 | | law. |
---|
28 | 30 | | SECTION 5. EXEMPTED REPORTS. Effective on the later of the |
---|
29 | 31 | | effective date of the Act creating the report or August 31, 2025, |
---|
30 | 32 | | the following reports, if created or re-created by an Act of the |
---|
31 | 33 | | 89th Legislature, Regular Session, 2025, are exempt from Section 2 |
---|
32 | 34 | | of this Act, and the reports are created or re-created as specified |
---|
33 | 35 | | by the Act creating or re-creating the report: |
---|
34 | 36 | | (1) the [report] established by House Bill No. ____ or |
---|
35 | 37 | | similar legislation; |
---|
36 | 38 | | SECTION 6. EFFECT OF ACT. (a) This Act prevails over any |
---|
37 | 39 | | other Act of the 89th Legislature, Regular Session, 2025, that |
---|
38 | 40 | | purports to create or re-create a report, regardless of the |
---|
39 | 41 | | relative dates of enactment,. |
---|
40 | 42 | | (b) An exemption from the application of this act, contained |
---|
41 | 43 | | in another Act of the 89th Legislature, Regular Session, 2025, that |
---|
42 | 44 | | is exempted from the application of Section 2 of this Act has no |
---|
43 | 45 | | effect. |
---|
44 | 46 | | SECTION 7. EFFECTIVE DATE. Except as otherwise provided by |
---|
45 | 47 | | this Act: |
---|
46 | 48 | | (1) this Act takes effect immediately if this Act |
---|
47 | 49 | | receives a vote of two-thirds of all the members elected to each |
---|
48 | 50 | | house, as provided by Section 39, Article III, Texas Constitution; |
---|
49 | 51 | | and |
---|
50 | 52 | | (2) if this Act does not receive the vote necessary for |
---|
51 | 53 | | immediate effect, this Act takes effect on the 91st day after the |
---|
52 | 54 | | last day of the legislative session. |
