By: Capriglione H.B. No. 5469 A BILL TO BE ENTITLED AN ACT relating to the abolishment, creation, and re-creation of reports. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. DEFINITION. In this Act "report" means an ad hoc or periodic publication, study, compilation of information, statement or written work product produced by an agency in the executive or judicial branch of state government for distribution to the legislature or an agency in the legislative branch of state government and includes reports that are also for distribution to an officer or agency in the executive branch of state government. SECTION 2. ABOLITION OF REPORTS. Except as otherwise specifically provided by this Act, all reports created by law enacted or re-enacted by an Act of the 89th Legislature, Regular Session, 2025, that becomes law are abolished on the later of August 31, 2025, or the date the Act creating the report takes effect. SECTION 3. PREVIOUSLY EXEMPT REPORTS; CONSTITUTIONAL REPORTS. Section 2 of this Act does not apply to reports that were created by law enacted before the 89th Legislature convened, or to reports required by state constitutional law. SECTION 4. FEDERAL REPORTS. Section 2 of this Act does not apply to reports created under an Act of the 89th Legislature, Regular Session, 2025, for which the report is required by federal law. SECTION 5. EXEMPTED REPORTS. Effective on the later of the effective date of the Act creating the report or August 31, 2025, the following reports, if created or re-created by an Act of the 89th Legislature, Regular Session, 2025, are exempt from Section 2 of this Act, and the reports are created or re-created as specified by the Act creating or re-creating the report: (1) the [report] established by House Bill No. ____ or similar legislation; SECTION 6. EFFECT OF ACT. (a) This Act prevails over any other Act of the 89th Legislature, Regular Session, 2025, that purports to create or re-create a report, regardless of the relative dates of enactment,. (b) An exemption from the application of this act, contained in another Act of the 89th Legislature, Regular Session, 2025, that is exempted from the application of Section 2 of this Act has no effect. SECTION 7. EFFECTIVE DATE. Except as otherwise provided by this Act: (1) this Act takes effect immediately if this Act receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution; and (2) if this Act does not receive the vote necessary for immediate effect, this Act takes effect on the 91st day after the last day of the legislative session.
