77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the dissolution of the El Milagro Management District.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. (a) Except as provided by Subsection (b), the
1212 board of the El Milagro Management District, created by order of the
1313 Texas Commission on Environmental Quality on June 13, 2024, shall
1414 dissolve the district not later than the 60th day after the
1515 effective date of this Act.
1616 (b) If the district has outstanding bonded indebtedness:
1717 (1) the district shall remain in existence solely for
1818 the purposes of winding up district operations and discharging its
1919 bonded indebtedness; and
2020 (2) the board shall use all district money that is
2121 available to:
2222 (A) wind up district operations; and
2323 (B) repay or defease the bonded indebtedness as
2424 soon as practicable in accordance with the order or resolution
2525 authorizing the issuance of the bonds.
2626 (c) This Act expires September 1, 2027.
2727 SECTION 2. (a) The legal notice of the intention to
2828 introduce this Act, setting forth the general substance of this
2929 Act, has been published as provided by law, and the notice and a
3030 copy of this Act have been furnished to all persons, agencies,
3131 officials, or entities to which they are required to be furnished
3232 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
3333 Government Code.
3434 (b) The governor, one of the required recipients, has
3535 submitted the notice and Act to the Texas Commission on
3636 Environmental Quality.
3737 (c) The Texas Commission on Environmental Quality has filed
3838 its recommendations relating to this Act with the governor, the
3939 lieutenant governor, and the speaker of the house of
4040 representatives within the required time.
4141 (d) All requirements of the constitution and laws of this
4242 state and the rules and procedures of the legislature with respect
4343 to the notice, introduction, and passage of this Act are fulfilled
4444 and accomplished.
4545 SECTION 3. This Act takes effect immediately if it receives
4646 a vote of two-thirds of all the members elected to each house, as
4747 provided by Section 39, Article III, Texas Constitution. If this
4848 Act does not receive the vote necessary for immediate effect, this
4949 Act takes effect September 1, 2025.
