9 | 9 | | relating to the powers and duties of the Far North Fort Worth |

10 | 10 | | Municipal Utility District No. 1 of Tarrant and Wise Counties; |

11 | 11 | | providing authority to impose a tax and issue bonds. |

12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 13 | | SECTION 1. Subchapter B, Chapter 8011, Special District |
---|
14 | 14 | | Local Laws Code, is amended by adding Section 8011.055 to read as |
---|
15 | 15 | | follows: |
---|
16 | 16 | | Sec. 8011.055. AUTHORITY TO ESTABLISH DEFINED AREAS OR |
---|
17 | 17 | | DESIGNATED PROPERTY. Notwithstanding the acreage requirement |
---|
18 | 18 | | under Section 54.801(a), Water Code, the district may define areas |
---|
19 | 19 | | or designate certain property of the district and impose taxes and |
---|
20 | 20 | | issue bonds in the defined area or designated property as provided |
---|
21 | 21 | | by Subchapter J, Chapter 54, Water Code, to pay for improvements, |
---|
22 | 22 | | facilities, or services that primarily benefit that area or |
---|
23 | 23 | | property and do not generally and directly benefit the district as a |
---|
24 | 24 | | whole. Notwithstanding any other provision of law, a defined area |
---|
25 | 25 | | may include a noncontiguous tract. |
---|
26 | 26 | | SECTION 2. The Far North Fort Worth Municipal Utility |
---|
27 | 27 | | District No. 1 of Tarrant and Wise Counties retains all rights, |
---|
28 | 28 | | powers, privileges, authority, duties, and functions that it had |
---|
29 | 29 | | before the effective date of this Act. |
---|
30 | 30 | | SECTION 3. (a) The legal notice of the intention to |
---|
31 | 31 | | introduce this Act, setting forth the general substance of this |
---|
32 | 32 | | Act, has been published as provided by law, and the notice and a |
---|
33 | 33 | | copy of this Act have been furnished to all persons, agencies, |
---|
34 | 34 | | officials, or entities to which they are required to be furnished |
---|
35 | 35 | | under Section 59, Article XVI, Texas Constitution, and Chapter 313, |
---|
36 | 36 | | Government Code. |
---|
37 | 37 | | (b) The governor, one of the required recipients, has |
---|
38 | 38 | | submitted the notice and Act to the Texas Commission on |
---|
39 | 39 | | Environmental Quality. |
---|
40 | 40 | | (c) The Texas Commission on Environmental Quality has filed |
---|
41 | 41 | | its recommendations relating to this Act with the governor, the |
---|
42 | 42 | | lieutenant governor, and the speaker of the house of |
---|
43 | 43 | | representatives within the required time. |
---|
44 | 44 | | (d) All requirements of the constitution and laws of this |
---|
45 | 45 | | state and the rules and procedures of the legislature with respect |
---|
46 | 46 | | to the notice, introduction, and passage of this Act are fulfilled |
---|
47 | 47 | | and accomplished. |
---|
48 | 48 | | SECTION 4. This Act takes effect immediately if it receives |
---|
49 | 49 | | a vote of two-thirds of all the members elected to each house, as |
---|
50 | 50 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
51 | 51 | | Act does not receive the vote necessary for immediate effect, this |
---|
52 | 52 | | Act takes effect September 1, 2025. |
