77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a request by a member of the legislature for an
1010 unannounced inspection of a concrete batch plant by the Texas
1111 Commission on Environmental Quality.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter C, Chapter 382, Health and Safety
1414 Code, is amended by adding Section 382.070 to read as follows:
1515 Sec. 382.070. LEGISLATOR REQUEST FOR INSPECTION OF CERTAIN
1616 CONCRETE PLANTS. (a) This section applies only to a concrete plant
1717 that performs wet batching, dry batching, or central mixing
1818 operating under a permit issued under this chapter.
1919 (b) A member of the legislature may request that the
2020 commission conduct an unannounced inspection of a concrete plant on
2121 behalf of a person who:
2222 (1) permanently resides in the member's district;
2323 (2) qualifies as a person who may be affected under
2424 Section 382.058(c); and
2525 (3) submits a written complaint to the member.
2626 (c) The commission shall prioritize responding to a request
2727 filed by a member of the legislature under this section.
2828 (d) The commission shall maintain a file on the request in
2929 the manner provided by Section 5.176(a), Water Code. Section
3030 5.176(c), Water Code, applies to a request filed under this
3131 section.
3232 (e) The commission shall provide to the member of the
3333 legislature and the person who submitted the complaint to the
3434 member:
3535 (1) the policies and procedures described by Section
3636 5.177(a), Water Code; and
3737 (2) the notice described by Section 5.177(b), Water
3838 Code.
3939 (f) If the commission denies a request for an unannounced
4040 inspection, the commission shall provide an explanation of the
4141 reason the request was denied to the member of the legislature and
4242 the person who submitted the complaint not later than the 90th day
4343 after the request was filed.
4444 SECTION 2. This Act takes effect September 1, 2025.
