 A BILL TO BE ENTITLED
 AN ACT
 relating to a request by a member of the legislature for an
 unannounced inspection of a permanent concrete batch plant by the
 Texas Commission on Environmental Quality.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Subchapter C, Chapter 382, Health and Safety
 Code, is amended by adding Section 382.070 to read as follows:
 Sec. 382.070.  LEGISLATOR REQUEST FOR INSPECTION OF CERTAIN
 CONCRETE PLANTS. (a)  This section applies only to a permanent
 concrete plant that performs wet batching, dry batching, or central
 mixing operating under an authorization to use a standard permit
 issued under Section 382.05195 or 382.05198.
 (b)  A member of the legislature may request that the
 commission conduct an unannounced inspection of a concrete plant on
 behalf of a person who:
 (1)  permanently resides in the member's district;
 (2)  qualifies as a person who may be affected under
 Section 382.058(c); and
 (3)  submits a written complaint to the member.
 (c)  The commission shall prioritize responding to a request
 filed by a member of the legislature under this section.
 (d)  The commission shall maintain a file on the request in
 the manner provided by Section 5.176(a), Water Code.  Section
 5.176(c), Water Code, applies to a request filed under this
 section.
 (e)  The commission shall provide to the member of the
 legislature and the person who submitted the complaint to the
 member:
 (1)  the policies and procedures described by Section
 5.177(a), Water Code; and
 (2)  the notice described by Section 5.177(b), Water
 Code.
 (f)  If the commission denies a request for an unannounced
 inspection, the commission shall provide an explanation of the
 reason the request was denied to the member of the legislature and
 the person who submitted the complaint not later than the 90th day
 after the request was filed.
 SECTION 2.  This Act takes effect September 1, 2025.
