77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a halal food option for breakfast and lunch programs
1010 provided by certain public schools.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter Z, Chapter 33, Education Code, is
1313 amended by adding Section 33.911 to read as follows:
1414 Sec. 33.911. HALAL BREAKFAST AND LUNCH OPTION. (a) In this
1515 section, "halal" has the meaning assigned by Section 17.881,
1616 Business & Commerce Code.
1717 (b) This section applies only to a school district or
1818 open-enrollment charter school that is wholly or partly located in
1919 a county:
2020 (1) with a population of 2.1 million or more; or
2121 (2) that is adjacent to a county described by
2222 Subdivision (1).
2323 (c) On request by a student or the parent or person standing
2424 in parental relation to the student, a school district or
2525 open-enrollment charter school to which this section applies shall
2626 provide a halal option to the student for any breakfast or lunch
2727 program provided by the district or school.
2828 SECTION 2. This Act applies beginning with the 2025-2026
2929 school year.
3030 SECTION 3. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2025.
