75 A BILL TO BE ENTITLED
86 AN ACT
97 relating to human trafficking prevention, including training for
108 medical assistants, disclosure of human trafficking information by
119 certain health care facilities, and protection for facility
1210 employees who report human trafficking.
1311 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1412 SECTION 1. Subtitle G, Title 4, Health and Safety Code, is
1513 amended by adding Chapter 328 to read as follows:
1614 CHAPTER 328. HUMAN TRAFFICKING PREVENTION IN CERTAIN FACILITIES
1715 Sec. 328.001. DEFINITIONS. In this chapter:
1816 (1) "Facility" has the meaning assigned by Section
1917 31.002.
2018 (2) "Medical assistant" has the meaning assigned by
2119 Section 763.001.
2220 Sec. 328.002. HUMAN TRAFFICKING SIGNS REQUIRED. (a) A
2321 facility shall display a sign, at least 11 inches by 17 inches in
2422 size, written in at least a 16-point font and in the form prescribed
2523 by the attorney general, that includes:
2624 (1) the following statements:
2725 (A) "All health care practitioners and medical
2826 assistants are required to receive human trafficking prevention
2927 training."; and
3028 (B) "An employee may not be disciplined,
3129 retaliated against, or otherwise discriminated against for
3230 reporting in good faith a suspected act of human trafficking.";
3331 (2) information on recognizing and reporting human
3432 trafficking and a list of human trafficking indicators;
3533 (3) a phone number the attorney general designates for
3634 reporting a suspected act of human trafficking or a violation of
3735 this chapter; and
3836 (4) contact information for reporting suspicious
3937 activity to the Department of Public Safety.
4038 (b) The sign described by Subsection (a) must be posted:
4139 (1) in a location easily visible to all facility
4240 employees; and
4341 (2) separately in English, Spanish, and any other
4442 primary language spoken by 10 percent or more of the facility's
4543 employees.
4644 Sec. 328.003. DISCRIMINATION AND RETALIATION PROHIBITED. A
4745 facility may not discipline, retaliate against, or otherwise
4846 discriminate against a facility employee who in good faith reports
4947 a suspected act of human trafficking to the facility, a law
5048 enforcement agency, the National Human Trafficking Resource
5149 Center, the attorney general, or another appropriate authority.
5250 SECTION 2. Subtitle A, Title 9, Health and Safety Code, is
5351 amended by adding Chapter 763 to read as follows:
5452 CHAPTER 763. HUMAN TRAFFICKING PREVENTION TRAINING
5553 SUBCHAPTER A. TRAINING FOR MEDICAL ASSISTANTS
5654 Sec. 763.001. DEFINITIONS. In this subchapter:
5755 (1) "Commission" means the Health and Human Services
5856 Commission.
5957 (2) "Executive commissioner" means the executive
6058 commissioner of the Health and Human Services Commission.
6159 (3) "Human trafficking" means conduct that
6260 constitutes an offense under Section 20A.02, Penal Code.
6361 (4) "Medical assistant" means an individual who, under
6462 the supervision of a physician, assists with patient care
6563 management, executes administrative duties, and performs clinical
6664 procedures, including:
6765 (A) conducting aseptic procedures;
6866 (B) obtaining vital signs;
6967 (C) preparing patients for the physician's care;
7068 (D) performing venipunctures and non-intravenous
7169 injections;
7270 (E) observing and reporting patients' symptoms;
7371 (F) administering basic first aid;
7472 (G) assisting with patient examinations or
7573 treatments;
7674 (H) operating office medical equipment;
7775 (I) collecting routine laboratory specimens, as
7876 directed by the physician;
7977 (J) administering medication, as directed by the
8078 physician;
8179 (K) performing basic laboratory procedures; and
8280 (L) performing dialysis procedures, including
8381 home dialysis.
8482 Sec. 763.002. REQUIRED HUMAN TRAFFICKING TRAINING. A
8583 medical assistant, within the time prescribed by commission rule,
8684 shall successfully complete a training course approved by the
8785 executive commissioner on identifying, assisting, and reporting
8886 victims of human trafficking.
8987 Sec. 763.003. TRAINING COURSE APPROVAL. (a) The executive
9088 commissioner shall:
9189 (1) approve training courses on human trafficking
9290 prevention, including at least one course available without charge;
9391 and
9492 (2) post a list of the approved training courses on the
9593 commission's Internet website.
9694 (b) The executive commissioner shall update the list of
9795 approved training courses described by Subsection (a) as necessary
9896 and consider for approval training courses conducted by health care
9997 facilities.
10098 SECTION 3. As soon as practicable after the effective date
10199 of this Act, the attorney general shall design the sign required by
102100 Section 328.002, Health and Safety Code, as added by this Act.
103101 SECTION 4. As soon as practicable after the effective date
104102 of this Act, the executive commissioner of the Health and Human
105103 Services Commission shall approve and post on the commission's
106104 Internet website the list of approved human trafficking prevention
107105 training courses and adopt rules necessary to implement Subchapter
108106 A, Chapter 763, Health and Safety Code, as added by this Act.
109107 SECTION 5. This Act takes effect September 1, 2025.
