77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the execution of a waiver of citation by digitized
1010 signature in a suit for the dissolution of a marriage.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 6.4035(e), Family Code, is amended to
1313 read as follows:
1414 (e) The party executing the waiver may [not] sign the waiver
1515 using a digitized signature.
1616 SECTION 2. Section 406.026, Government Code, is amended to
1717 read as follows:
1818 Sec. 406.026. ELECTRONIC NOTARIZATION. In a proceeding
1919 filed under Title 1 or 5, Family Code, if a signature is required to
2020 be notarized, acknowledged, verified, or made under oath, the
2121 requirement may be satisfied if the electronic signature of the
2222 person authorized to perform that act, together with all other
2323 information required to be included by other applicable law, is
2424 attached to or logically associated with the signature required to
2525 be notarized, acknowledged, verified, or made under oath.
2626 SECTION 3. The change in law made by this Act applies to a
2727 waiver of citation executed in a suit for dissolution of a marriage
2828 that is pending in a trial court on the effective date of this Act or
2929 that is filed on or after that date.
3030 SECTION 4. This Act takes effect September 1, 2025.
