| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 6.4035(e), Family Code, is amended to |
|---|
| 13 | 13 | | read as follows: |
|---|
| 14 | 14 | | (e) The party executing the waiver may [not] sign the waiver |
|---|
| 15 | 15 | | using a digitized signature. |
|---|
| 16 | 16 | | SECTION 2. Section 406.026, Government Code, is amended to |
|---|
| 17 | 17 | | read as follows: |
|---|
| 18 | 18 | | Sec. 406.026. ELECTRONIC NOTARIZATION. In a proceeding |
|---|
| 19 | 19 | | filed under Title 1 or 5, Family Code, if a signature is required to |
|---|
| 20 | 20 | | be notarized, acknowledged, verified, or made under oath, the |
|---|
| 21 | 21 | | requirement may be satisfied if the electronic signature of the |
|---|
| 22 | 22 | | person authorized to perform that act, together with all other |
|---|
| 23 | 23 | | information required to be included by other applicable law, is |
|---|
| 24 | 24 | | attached to or logically associated with the signature required to |
|---|
| 25 | 25 | | be notarized, acknowledged, verified, or made under oath. |
|---|
| 26 | 26 | | SECTION 3. The change in law made by this Act applies to a |
|---|
| 27 | 27 | | waiver of citation executed in a suit for dissolution of a marriage |
|---|
| 28 | 28 | | that is pending in a trial court on the effective date of this Act or |
|---|
| 29 | 29 | | that is filed on or after that date. |
|---|
| 30 | 30 | | SECTION 4. This Act takes effect September 1, 2025. |
