| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Sections 214.212(a) and (d), Local Government |
|---|
| 13 | 13 | | Code, are amended to read as follows: |
|---|
| 14 | 14 | | (a) To protect the public health, safety, and welfare, the |
|---|
| 15 | 15 | | International Residential Code, as it existed on May 1, 2021 |
|---|
| 16 | 16 | | [2012], is adopted as a municipal residential building code in this |
|---|
| 17 | 17 | | state. |
|---|
| 18 | 18 | | (d) A municipality may review and consider amendments made |
|---|
| 19 | 19 | | by the International Code Council to the International Residential |
|---|
| 20 | 20 | | Code after May 1, 2021 [2012]. |
|---|
| 21 | 21 | | SECTION 2. Sections 214.216(a) and (d), Local Government |
|---|
| 22 | 22 | | Code, are amended to read as follows: |
|---|
| 23 | 23 | | (a) To protect the public health, safety, and welfare, the |
|---|
| 24 | 24 | | International Building Code, as it existed on May 1, 2021 [2012], is |
|---|
| 25 | 25 | | adopted as a municipal commercial building code in this state. |
|---|
| 26 | 26 | | (d) A municipality may review and consider amendments made |
|---|
| 27 | 27 | | by the International Code Council to the International Building |
|---|
| 28 | 28 | | Code after May 1, 2021 [2012]. |
|---|
| 29 | 29 | | SECTION 3. (a) Sections 214.212 and 214.216, Local |
|---|
| 30 | 30 | | Government Code, as amended by this Act, apply only to residential |
|---|
| 31 | 31 | | or commercial construction, remodeling, alteration, enlargement, |
|---|
| 32 | 32 | | or repair that begins under an agreement made on or after January 1, |
|---|
| 33 | 33 | | 2026, or that begins, in the absence of an agreement, on or after |
|---|
| 34 | 34 | | that date. Residential or commercial construction, remodeling, |
|---|
| 35 | 35 | | alteration, enlargement, or repair that begins under an agreement |
|---|
| 36 | 36 | | made before January 1, 2026, or that begins, in the absence of an |
|---|
| 37 | 37 | | agreement, before that date is governed by the law in effect when |
|---|
| 38 | 38 | | the agreement was made or the activity began, as appropriate, and |
|---|
| 39 | 39 | | that law is continued in effect for that purpose. |
|---|
| 40 | 40 | | (b) Not later than December 1, 2025, municipalities shall |
|---|
| 41 | 41 | | establish rules and take other necessary actions to implement |
|---|
| 42 | 42 | | Sections 214.212 and 214.216, Local Government Code, as amended by |
|---|
| 43 | 43 | | this Act. |
|---|
| 44 | 44 | | SECTION 4. This Act takes effect September 1, 2025. |
