66 A JOINT RESOLUTION
77 applying to the Congress of the United States to call a convention
88 under Article V of the United States Constitution for the limited
99 purpose of proposing one or more amendments to the constitution to
1010 impose fiscal restraints on the federal government, to limit the
1111 power and jurisdiction of the federal government, and to limit the
1212 terms of office of federal officials and members of Congress.
1313 WHEREAS, The drafters of the United States Constitution
1414 empowered state legislatures to be guardians of liberty against
1515 abuses of power by the federal government; and
1616 WHEREAS, The federal government has abused its power by
1717 creating a crushing national debt through improper and imprudent
1818 spending; and
1919 WHEREAS, The federal government has abused its power by
2020 invading the legitimate role of the states through the manipulative
2121 process of federal mandates that are to a great extent unfunded; and
2222 WHEREAS, The federal government has ceased to abide by a
2323 proper interpretation of the United States Constitution; and
2424 WHEREAS, It is the solemn duty of state legislatures to
2525 protect the liberty of the people and of future generations by
2626 proposing amendments to the United States Constitution that place
2727 clear restraints on federal power; and
2828 WHEREAS, Article V of the United States Constitution
2929 authorizes the several state legislatures to restrict the power of
3030 the federal government through the amendment process; and
3131 WHEREAS, Article V of the United States Constitution provides
3232 that on application of the legislatures of two-thirds of the
3333 several states Congress shall call a convention for the purpose of
3434 proposing amendments to the constitution; now, therefore, be it
3535 RESOLVED, That the 89th Legislature of the State of Texas,
3636 Regular Session, 2025, hereby apply to Congress to call a
3737 convention under Article V of the United States Constitution for
3838 the limited purpose of proposing one or more amendments to the
3939 constitution to impose fiscal restraints on the federal government,
4040 to limit the power and jurisdiction of the federal government, and
4141 to limit the terms of office of federal officials and members of
4242 Congress; and, be it further
4343 RESOLVED, That, unless rescinded by a succeeding
4444 legislature, this application by the 89th Legislature of the State
4545 of Texas constitutes a continuing application in accordance with
4646 Article V of the United States Constitution until at least
4747 two-thirds of the legislatures of the several states have applied
4848 to Congress to call a convention for the limited purpose of
4949 proposing one or more amendments to the constitution to impose
5050 fiscal restraints on the federal government, to limit the power and
5151 jurisdiction of the federal government, and to limit the terms of
5252 office of federal officials and members of Congress; and, be it
5353 further
5454 RESOLVED, That the Texas secretary of state forward official
5555 copies of this resolution to the president of the United States, to
5656 the speaker of the House of Representatives and the president of the
5757 Senate of the Congress of the United States, and to all members of
5858 the Texas delegation to Congress with the request that this
5959 resolution be officially entered in the Congressional Record as an
6060 application to Congress for a convention under Article V of the
6161 United States Constitution for the limited purpose of proposing one
6262 or more amendments to the constitution to impose fiscal restraints
6363 on the federal government, to limit the power and jurisdiction of
6464 the federal government, and to limit the terms of office of federal
6565 officials and members of Congress; and, be it further
6666 RESOLVED, That the Texas secretary of state forward official
6767 copies of this resolution to the secretaries of state and to the
6868 presiding officers of the legislatures of the several states with
6969 the request that they join this state in applying to Congress for a
7070 convention under Article V of the United States Constitution for
7171 the limited purpose of proposing one or more amendments to the
7272 constitution to impose fiscal restraints on the federal government,
7373 to limit the power and jurisdiction of the federal government, and
7474 to limit the terms of office of federal officials and members of
7575 Congress.
