12 | 15 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 16 | | SECTION 1. Section 9.004(a), Local Government Code, is |
---|
14 | 17 | | amended to read as follows: |

15 | 18 | | (a) Except as provided by Sections 9.0041 and [Section] |
---|
16 | 19 | | 9.0045, the governing body of a municipality on its own motion may |
---|
17 | 20 | | submit a proposed charter amendment to the municipality's qualified |
---|
18 | 21 | | voters for their approval at an election. The governing body shall |
---|
19 | 22 | | submit a proposed charter amendment to the voters for their |
---|
20 | 23 | | approval at an election if the submission is supported by a petition |
---|
21 | 24 | | signed by a number of qualified voters of the municipality equal to |
---|
22 | 25 | | at least five percent of the number of qualified voters of the |
---|
23 | 26 | | municipality or 20,000, whichever number is the smaller. |

24 | 27 | | SECTION 2. Chapter 9, Local Government Code, is amended by |
---|
25 | 28 | | adding Section 9.0041 to read as follows: |

26 | 29 | | Sec. 9.0041. AUTHORITY TO PROPOSE CHARTER AMENDMENT |
---|
27 | 30 | | CONTRARY TO STATE LAW. The governing body of a municipality may not |
---|
28 | 31 | | submit a proposed charter amendment to the voters for approval if |
---|
29 | 32 | | application of the provisions of the amendment would be contrary to |
---|
30 | 33 | | state law. |
---|
31 | 34 | | SECTION 3. This Act takes effect September 1, 2025. |
