69 A BILL TO BE ENTITLED
710 AN ACT
811 relating to the authority of the governing body of a home-rule
912 municipality to submit a proposed charter amendment to the voters
1013 for approval if application of the provisions of the amendment
1114 would be contrary to state law.
1215 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1316 SECTION 1. Section 9.004(a), Local Government Code, is
1417 amended to read as follows:
1518 (a) Except as provided by Sections 9.0041 and [Section]
1619 9.0045, the governing body of a municipality on its own motion may
1720 submit a proposed charter amendment to the municipality's qualified
1821 voters for their approval at an election. The governing body shall
1922 submit a proposed charter amendment to the voters for their
2023 approval at an election if the submission is supported by a petition
2124 signed by a number of qualified voters of the municipality equal to
2225 at least five percent of the number of qualified voters of the
2326 municipality or 20,000, whichever number is the smaller.
2427 SECTION 2. Chapter 9, Local Government Code, is amended by
2528 adding Section 9.0041 to read as follows:
2629 Sec. 9.0041. AUTHORITY TO PROPOSE CHARTER AMENDMENT
2730 CONTRARY TO STATE LAW. The governing body of a municipality may not
2831 submit a proposed charter amendment to the voters for approval if
2932 application of the provisions of the amendment would be contrary to
3033 state law.
3134 SECTION 3. This Act takes effect September 1, 2025.
