611 A BILL TO BE ENTITLED
712 AN ACT
813 relating to the type of newspaper required for publication of
914 public notices.
1015 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1116 SECTION 1. Section 2051.0441, Government Code, is amended
1217 by amending Subsection (b) and adding Subsection (b-1) to read as
1318 follows:
1419 (b) Except as provided by Subsection (b-1), the [The]
1520 newspaper in which a notice is published under this section must:
1621 (1) devote not less than 20 percent of its total column
1722 lineage to general interest items;
1823 (2) be published at least once each week;
1924 (3) be entered as periodical postal matter in the
2025 county where published or have a mailed or delivered circulation of
2126 at least 51 percent of the residences in the county where published;
2227 and
2328 (4) have been published regularly and continuously for
2429 at least 12 months before the governmental entity or representative
2530 publishes notice.
2631 (b-1) In lieu of publishing a notice in a newspaper under
2732 Subsection (b), a governmental entity may publish a notice in a
2833 digital newspaper if that digital newspaper:
2934 (1) has an audited paid-subscriber base;
3035 (2) has been in business for at least three years;
3136 (3) employs staff in the jurisdiction of the
3237 governmental entity;
3338 (4) reports on local events and governmental
3439 activities in the jurisdiction of the governmental entity;
3540 (5) provides news of general interest to people in the
3641 jurisdiction of the governmental entity; and
3742 (6) updates its news at least once each week.
3843 SECTION 2. This Act takes effect immediately if it receives
3944 a vote of two-thirds of all the members elected to each house, as
4045 provided by Section 39, Article III, Texas Constitution. If this
4146 Act does not receive the vote necessary for immediate effect, this
4247 Act takes effect September 1, 2025.
