| 10 | 15 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 16 | | SECTION 1. Section 2051.0441, Government Code, is amended |
|---|
| 12 | 17 | | by amending Subsection (b) and adding Subsection (b-1) to read as |
|---|
| 13 | 18 | | follows: |
|---|
| 14 | 19 | | (b) Except as provided by Subsection (b-1), the [The] |
|---|
| 15 | 20 | | newspaper in which a notice is published under this section must: |
|---|
| 16 | 21 | | (1) devote not less than 20 percent of its total column |
|---|
| 17 | 22 | | lineage to general interest items; |
|---|
| 18 | 23 | | (2) be published at least once each week; |
|---|
| 19 | 24 | | (3) be entered as periodical postal matter in the |
|---|
| 20 | 25 | | county where published or have a mailed or delivered circulation of |
|---|
| 21 | 26 | | at least 51 percent of the residences in the county where published; |
|---|
| 22 | 27 | | and |
|---|
| 23 | 28 | | (4) have been published regularly and continuously for |
|---|
| 24 | 29 | | at least 12 months before the governmental entity or representative |
|---|
| 25 | 30 | | publishes notice. |
|---|
| 26 | 31 | | (b-1) In lieu of publishing a notice in a newspaper under |
|---|
| 27 | 32 | | Subsection (b), a governmental entity may publish a notice in a |
|---|
| 28 | 33 | | digital newspaper if that digital newspaper: |
|---|
| 29 | 34 | | (1) has an audited paid-subscriber base; |
|---|
| 30 | 35 | | (2) has been in business for at least three years; |
|---|
| 31 | 36 | | (3) employs staff in the jurisdiction of the |
|---|
| 32 | 37 | | governmental entity; |
|---|
| 33 | 38 | | (4) reports on local events and governmental |
|---|
| 34 | 39 | | activities in the jurisdiction of the governmental entity; |
|---|
| 35 | 40 | | (5) provides news of general interest to people in the |
|---|
| 36 | 41 | | jurisdiction of the governmental entity; and |
|---|
| 37 | 42 | | (6) updates its news at least once each week. |
|---|
| 38 | 43 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 39 | 44 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 40 | 45 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 41 | 46 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 42 | 47 | | Act takes effect September 1, 2025. |
