69 A BILL TO BE ENTITLED
710 AN ACT
811 relating to certain mammography reports providing required breast
912 density information.
1013 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1114 SECTION 1. Section 86.013(a), Health and Safety Code, is
1215 amended to read as follows:
1316 (a) A [On completion of a mammogram, a] mammography
1417 facility certified by the United States Food and Drug
1518 Administration or by a certification agency approved by the United
1619 States Food and Drug Administration shall:
1720 (1) be aware of and comply with all applicable federal
1821 and state "dense breast" reporting requirements; and
1922 (2) on completion of a mammogram provide to the
2023 patient:
2124 (A) based on the patient's reported breast
2225 density, [the following] notice that includes one of the following:
2326 (i) for a mammography report identifying
2427 the patient's breast density as "The breasts are almost entirely
2528 fatty" or "There are scattered areas of fibroglandular density,"
2629 the statement: "Breast tissue can be either dense or not dense.
2730 Dense tissue makes it harder to find breast cancer on a mammogram
2831 and also raises the risk of developing breast cancer. Your breast
2932 tissue is not dense. Talk to your healthcare provider about breast
3033 density, risks for breast cancer, and your individual situation.";

3235 (ii) for a mammography report identifying
3336 the patient's breast density as "The breasts are heterogeneously
3437 dense, which may obscure small masses" or "The breasts are
3538 extremely dense, which lowers the sensitivity of mammography," the
3639 statement: "Breast tissue can be either dense or not dense. Dense
3740 tissue makes it harder to find breast cancer on a mammogram and also
3841 raises the risk of developing breast cancer. Your breast tissue is
3942 dense. In some people with dense tissue, other imaging tests in
4043 addition to a mammogram may help find cancers. Talk to your health
4144 care provider about breast density, risks for breast cancer, and
4245 your individual situation."; and
4346 (B) notice that includes the statement:
4447 ["If your mammogram demonstrates that you have dense breast
4548 tissue, which could hide abnormalities, and you have other risk
4649 factors for breast cancer that have been identified, you might
4750 benefit from supplemental screening tests that may be suggested by
4851 your ordering physician.
4952 ["Dense breast tissue, in and of itself, is a relatively
5053 common condition. Therefore, this information is not provided to
5154 cause undue concern, but rather to raise your awareness and to
5255 promote discussion with your physician regarding the presence of
5356 other risk factors, in addition to dense breast tissue.]
5457 "A report of your mammography results will be sent to you and
5558 your physician. You should contact your physician if you have any
5659 questions or concerns regarding this report."
5760 SECTION 2. This Act takes effect September 1, 2025.
