| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Subchapter A, Chapter 234, Local Government |
|---|
| 14 | 14 | | Code, is amended by adding Section 234.0025 to read as follows: |
|---|
| 15 | 15 | | Sec. 234.0025. REGULATION OF JUNKYARDS, AUTOMOTIVE |
|---|
| 16 | 16 | | WRECKING AND SALVAGE YARDS, AND RECYCLING BUSINESSES. (a) This |
|---|
| 17 | 17 | | section applies only to a county: |
|---|
| 18 | 18 | | (1) in which a municipality with a population of |
|---|
| 19 | 19 | | 500,000 or more is located; and |
|---|
| 20 | 20 | | (2) that is located on an international border. |
|---|
| 21 | 21 | | (b) The commissioners court of a county by order may |
|---|
| 22 | 22 | | regulate the operation of a junkyard, automotive wrecking and |
|---|
| 23 | 23 | | salvage yard, or recycling business located in the unincorporated |
|---|
| 24 | 24 | | area of the county. |
|---|
| 25 | 25 | | (c) A commissioners court may not include in an order |
|---|
| 26 | 26 | | adopted under this section a requirement that conflicts with a |
|---|
| 27 | 27 | | similar requirement prescribed by another law governing a junkyard, |
|---|
| 28 | 28 | | automotive wrecking and salvage yard, or recycling business, |
|---|
| 29 | 29 | | including a requirement prescribed by Chapter 391, 396, or 397, |
|---|
| 30 | 30 | | Transportation Code. |
|---|
| 31 | 31 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 32 | 32 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 33 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 34 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 35 | | Act takes effect September 1, 2025. |
