77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the authority of certain counties to regulate
1010 junkyards, automotive wrecking and salvage yards, and recycling
1111 businesses.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter A, Chapter 234, Local Government
1414 Code, is amended by adding Section 234.0025 to read as follows:
1515 Sec. 234.0025. REGULATION OF JUNKYARDS, AUTOMOTIVE
1616 WRECKING AND SALVAGE YARDS, AND RECYCLING BUSINESSES. (a) This
1717 section applies only to a county:
1818 (1) in which a municipality with a population of
1919 500,000 or more is located; and
2020 (2) that is located on an international border.
2121 (b) The commissioners court of a county by order may
2222 regulate the operation of a junkyard, automotive wrecking and
2323 salvage yard, or recycling business located in the unincorporated
2424 area of the county.
2525 (c) A commissioners court may not include in an order
2626 adopted under this section a requirement that conflicts with a
2727 similar requirement prescribed by another law governing a junkyard,
2828 automotive wrecking and salvage yard, or recycling business,
2929 including a requirement prescribed by Chapter 391, 396, or 397,
3030 Transportation Code.
3131 SECTION 2. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2025.
