 A BILL TO BE ENTITLED
 AN ACT
 relating to the authority of certain counties to regulate
 junkyards, automotive wrecking and salvage yards, and recycling
 businesses.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Subchapter A, Chapter 234, Local Government
 Code, is amended by adding Section 234.0025 to read as follows:
 Sec. 234.0025.  REGULATION OF JUNKYARDS, AUTOMOTIVE
 WRECKING AND SALVAGE YARDS, AND RECYCLING BUSINESSES. (a) This
 section applies only to a county:
 (1)  in which a municipality with a population of
 500,000 or more is located; and
 (2)  that is located on an international border.
 (b)  The commissioners court of a county by order may
 regulate the operation of a junkyard, automotive wrecking and
 salvage yard, or recycling business located in the unincorporated
 area of the county.
 (c)  A commissioners court may not include in an order
 adopted under this section a requirement that conflicts with a
 similar requirement prescribed by another law governing a junkyard,
 automotive wrecking and salvage yard, or recycling business,
 including a requirement prescribed by Chapter 391, 396, or 397,
 Transportation Code.
 SECTION 2.  This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution.  If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2025.
