6	11		A BILL TO BE ENTITLED
7	12		AN ACT
8	13		relating to compensation, leave, and physical fitness programs and
9	14		standards for certain employees of the office of inspector general
10	15		of the Texas Juvenile Justice Department.
11	16		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	17		SECTION 1. Section 614.171(1), Government Code, is amended
13	18		to read as follows:
14	19		(1) "Law enforcement agency" means the Department of
15	20		Public Safety, Texas Alcoholic Beverage Commission, Texas
16	21		Department of Criminal Justice, Texas Juvenile Justice Department,
17	22		Parks and Wildlife Department, and [the] office of the attorney
18	23		general.
19	24		SECTION 2. Section 659.303, Government Code, is amended by
20	25		amending Subsections (a) and (d) and adding Subsection (a-1) to
21	26		read as follows:
22	27		(a) The department may include hazardous duty pay in the
23	28		compensation paid to an individual for services rendered during a
24	29		month if the individual[:
25	30		[(1)] has:
26	31		(1) [(A)] routine direct contact with youth:
27	32		(A) [(i)] placed in a residential facility of the
28	33		department; or
29	34		(B) [(ii)] released under the department's
30	35		supervision; and
31	36		(2) [(B)] completed at least 12 months of lifetime
32	37		service credit not later than the last day of the preceding month.
33	38		(a-1) The department shall include hazardous duty pay in the
34	39		compensation paid to an individual for services rendered during a
35	40		month if the individual[; or
36	41		[(2)] is an investigator, inspector general, security
37	42		officer, or apprehension specialist employed by the office of [the]
38	43		inspector general of the department.
39	44		(d) Except for the inclusion of hazardous duty pay in the
40	45		compensation paid to an individual described by Subsection (a-1)
41	46		[(a)(2)], the department may not pay hazardous duty pay:
42	47		(1) from funds authorized for payment of an
43	48		across-the-board employee salary increase; or
44	49		(2) to an employee who works at the department's
45	50		central office.
46	51		SECTION 3. Section 661.918(a), Government Code, is amended
47	52		to read as follows:
48	53		(a) This section applies to a peace officer under Article
49	54		2A.001, Code of Criminal Procedure, who is commissioned as a law
50	55		enforcement officer or agent, including a ranger, by:
51	56		(1) the Public Safety Commission and the director of
52	57		the Department of Public Safety;
53	58		(2) the Parks and Wildlife Commission;
54	59		(3) the Texas Alcoholic Beverage Commission;
55	60		(4) the attorney general;
56	61		(5) the insurance fraud unit of the Texas Department
57	62		of Insurance; [or]
58	63		(6) the comptroller; or
59	64		(7) the office of inspector general of the Texas
60	65		Juvenile Justice Department.
61	66		SECTION 4. Section 242.102, Human Resources Code, is
62	67		amended by adding Subsection (j) to read as follows:
63	68		(j) The department shall ensure that a peace officer
64	69		commissioned under Subsection (d) is compensated according to
65	70		Schedule C of the position classification salary schedule
66	71		prescribed by the General Appropriations Act.
67	72		SECTION 5. (a) The classification officer in the office of
68	73		the state auditor shall classify the position of commissioned peace
69	74		officer employed by the office of inspector general of the Texas
70	75		Juvenile Justice Department as a Schedule C position under the
71	76		position classification plan maintained under Chapter 654,
72	77		Government Code.
73	78		(b) The change made by the classification officer as
74	79		required by this section applies beginning with the state fiscal
75	80		biennium beginning September 1, 2025.
76	81		(c) This section expires September 1, 2027.
77	82		SECTION 6. Section 661.918(a), Government Code, as amended
78	83		by this Act, applies only to an injury that occurs on or after the
79	84		effective date of this Act.
80	85		SECTION 7. This Act takes effect September 1, 2025.
