611 A BILL TO BE ENTITLED
712 AN ACT
813 relating to compensation, leave, and physical fitness programs and
914 standards for certain employees of the office of inspector general
1015 of the Texas Juvenile Justice Department.
1116 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1217 SECTION 1. Section 614.171(1), Government Code, is amended
1318 to read as follows:
1419 (1) "Law enforcement agency" means the Department of
1520 Public Safety, Texas Alcoholic Beverage Commission, Texas
1621 Department of Criminal Justice, Texas Juvenile Justice Department,
1722 Parks and Wildlife Department, and [the] office of the attorney
1823 general.
1924 SECTION 2. Section 659.303, Government Code, is amended by
2025 amending Subsections (a) and (d) and adding Subsection (a-1) to
2126 read as follows:
2227 (a) The department may include hazardous duty pay in the
2328 compensation paid to an individual for services rendered during a
2429 month if the individual[:
2530 [(1)] has:
2631 (1) [(A)] routine direct contact with youth:
2732 (A) [(i)] placed in a residential facility of the
2833 department; or
2934 (B) [(ii)] released under the department's
3035 supervision; and
3136 (2) [(B)] completed at least 12 months of lifetime
3237 service credit not later than the last day of the preceding month.
3338 (a-1) The department shall include hazardous duty pay in the
3439 compensation paid to an individual for services rendered during a
3540 month if the individual[; or
3641 [(2)] is an investigator, inspector general, security
3742 officer, or apprehension specialist employed by the office of [the]
3843 inspector general of the department.
3944 (d) Except for the inclusion of hazardous duty pay in the
4045 compensation paid to an individual described by Subsection (a-1)
4146 [(a)(2)], the department may not pay hazardous duty pay:
4247 (1) from funds authorized for payment of an
4348 across-the-board employee salary increase; or
4449 (2) to an employee who works at the department's
4550 central office.
4651 SECTION 3. Section 661.918(a), Government Code, is amended
4752 to read as follows:
4853 (a) This section applies to a peace officer under Article
4954 2A.001, Code of Criminal Procedure, who is commissioned as a law
5055 enforcement officer or agent, including a ranger, by:
5156 (1) the Public Safety Commission and the director of
5257 the Department of Public Safety;
5358 (2) the Parks and Wildlife Commission;
5459 (3) the Texas Alcoholic Beverage Commission;
5560 (4) the attorney general;
5661 (5) the insurance fraud unit of the Texas Department
5762 of Insurance; [or]
5863 (6) the comptroller; or
5964 (7) the office of inspector general of the Texas
6065 Juvenile Justice Department.
6166 SECTION 4. Section 242.102, Human Resources Code, is
6267 amended by adding Subsection (j) to read as follows:
6368 (j) The department shall ensure that a peace officer
6469 commissioned under Subsection (d) is compensated according to
6570 Schedule C of the position classification salary schedule
6671 prescribed by the General Appropriations Act.
6772 SECTION 5. (a) The classification officer in the office of
6873 the state auditor shall classify the position of commissioned peace
6974 officer employed by the office of inspector general of the Texas
7075 Juvenile Justice Department as a Schedule C position under the
7176 position classification plan maintained under Chapter 654,
7277 Government Code.
7378 (b) The change made by the classification officer as
7479 required by this section applies beginning with the state fiscal
7580 biennium beginning September 1, 2025.
7681 (c) This section expires September 1, 2027.
7782 SECTION 6. Section 661.918(a), Government Code, as amended
7883 by this Act, applies only to an injury that occurs on or after the
7984 effective date of this Act.
8085 SECTION 7. This Act takes effect September 1, 2025.
