7	12		AN ACT
8	13		relating to election dates.
9	14		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	15		SECTION 1. Section 2.025(a), Election Code, is amended to
11	16		read as follows:
12	17		(a) Except as provided by Subsection (d) or as otherwise
13	18		provided by this code, a runoff election shall be held on a Tuesday
14	19		[Saturday] designated by the secretary of state.
15	20		SECTION 2. The heading to Section 41.001, Election Code, is
16	21		amended to read as follows:
17	22		Sec. 41.001. UNIFORM ELECTION DATE [DATES].
18	23		SECTION 3. Section 41.001, Election Code, is amended by
19	24		amending Subsections (a) and (c) and adding Subsection (e) to read
20	25		as follows:
21	26		(a) Except as otherwise provided by this subchapter, each
22	27		general or special election in this state shall be held on [one of
23	28		the following dates:
24	29		[(1) the first Saturday in May in an odd-numbered
25	30		year;
26	31		[(2) the first Saturday in May in an even-numbered
27	32		year, for an election held by a political subdivision other than a
28	33		county, or ordered by the governor; or
29	34		[(3)] the first Tuesday after the first Monday in
30	35		November.
31	36		(c) Except for an election under Subsection (a) or Section
32	37		41.0011 [or a runoff election following an election held under
33	38		Subsection (a)(2)], an election may not be held within 30 days
34	39		before or after the date of the general election for state and
35	40		county officers, general primary election, or runoff primary
36	41		election.
37	42		(e) Except for an election under Section 41.0011 or as
38	43		provided by Section 203.004(b), every election held in this state
39	44		shall be held on a Tuesday.
40	45		SECTION 4. Section 41.004(a), Election Code, is amended to
41	46		read as follows:
42	47		(a) If a law outside this code other than the constitution
43	48		requires a special election subject to Section 41.001(a) to be held
44	49		within a particular period after the occurrence of a certain event,
45	50		the election shall be held on the [an] authorized uniform election
46	51		date occurring within the period unless no uniform election date
47	52		within the period affords enough time to hold the election in the
48	53		manner required by law. In that case, Section 41.001(a) does not
49	54		apply [the election shall be held on the first authorized uniform
50	55		election date occurring after the expiration of the period].
51	56		SECTION 5. Section 41.0052(a), Election Code, is amended to
52	57		read as follows:
53	58		(a) The governing body of a political subdivision[, other
54	59		than a county or municipal utility district,] that holds its
55	60		general election for officers on a date other than the November
56	61		uniform election date shall [may], not later than December 31, 2025
57	62		[2016], change the date on which it holds its general election for
58	63		officers to the November uniform election date.
59	64		SECTION 6. Section 41.007(b), Election Code, is amended to
60	65		read as follows:
61	66		(b) The runoff primary election date is the second [fourth]
62	67		Tuesday in May following the general primary election.
63	68		SECTION 7. Sections 203.013(c) and (e), Election Code, are
64	69		amended to read as follows:
65	70		(c) The election must be held on a Tuesday [or Saturday]
66	71		occurring not earlier than the 21st day or later than the 45th day
67	72		after the date the election is ordered.
68	73		(e) If a runoff election is necessary, it must be held on a
69	74		Tuesday [or Saturday] occurring not earlier than the 12th day or
70	75		later than the 25th day after the date the election is ordered.
71	76		SECTION 8. The following provisions of the Election Code
72	77		are repealed:
73	78		(1) Section 41.001(d);
74	79		(2) Section 41.0052(a-1), as added by Chapter 1160
75	80		(S.B. 1131), Acts of the 88th Legislature, Regular Session, 2023;
76	81		(3) Section 41.0052(a-1), as added by Chapter 985
77	82		(S.B. 2620), Acts of the 88th Legislature, Regular Session, 2023;
78	83		and
79	84		(4) Section 85.001(e).
80	85		SECTION 9. This Act takes effect September 1, 2025.
