611 A BILL TO BE ENTITLED
712 AN ACT
813 relating to election dates.
914 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1015 SECTION 1. Section 2.025(a), Election Code, is amended to
1116 read as follows:
1217 (a) Except as provided by Subsection (d) or as otherwise
1318 provided by this code, a runoff election shall be held on a Tuesday
1419 [Saturday] designated by the secretary of state.
1520 SECTION 2. The heading to Section 41.001, Election Code, is
1621 amended to read as follows:
1722 Sec. 41.001. UNIFORM ELECTION DATE [DATES].
1823 SECTION 3. Section 41.001, Election Code, is amended by
1924 amending Subsections (a) and (c) and adding Subsection (e) to read
2025 as follows:
2126 (a) Except as otherwise provided by this subchapter, each
2227 general or special election in this state shall be held on [one of
2328 the following dates:
2429 [(1) the first Saturday in May in an odd-numbered
2530 year;
2631 [(2) the first Saturday in May in an even-numbered
2732 year, for an election held by a political subdivision other than a
2833 county, or ordered by the governor; or
2934 [(3)] the first Tuesday after the first Monday in
3035 November.
3136 (c) Except for an election under Subsection (a) or Section
3237 41.0011 [or a runoff election following an election held under
3338 Subsection (a)(2)], an election may not be held within 30 days
3439 before or after the date of the general election for state and
3540 county officers, general primary election, or runoff primary
3641 election.
3742 (e) Except for an election under Section 41.0011 or as
3843 provided by Section 203.004(b), every election held in this state
3944 shall be held on a Tuesday.
4045 SECTION 4. Section 41.004(a), Election Code, is amended to
4146 read as follows:
4247 (a) If a law outside this code other than the constitution
4348 requires a special election subject to Section 41.001(a) to be held
4449 within a particular period after the occurrence of a certain event,
4550 the election shall be held on the [an] authorized uniform election
4651 date occurring within the period unless no uniform election date
4752 within the period affords enough time to hold the election in the
4853 manner required by law. In that case, Section 41.001(a) does not
4954 apply [the election shall be held on the first authorized uniform
5055 election date occurring after the expiration of the period].
5156 SECTION 5. Section 41.0052(a), Election Code, is amended to
5257 read as follows:
5358 (a) The governing body of a political subdivision[, other
5459 than a county or municipal utility district,] that holds its
5560 general election for officers on a date other than the November
5661 uniform election date shall [may], not later than December 31, 2025
5762 [2016], change the date on which it holds its general election for
5863 officers to the November uniform election date.
5964 SECTION 6. Section 41.007(b), Election Code, is amended to
6065 read as follows:
6166 (b) The runoff primary election date is the second [fourth]
6267 Tuesday in May following the general primary election.
6368 SECTION 7. Sections 203.013(c) and (e), Election Code, are
6469 amended to read as follows:
6570 (c) The election must be held on a Tuesday [or Saturday]
6671 occurring not earlier than the 21st day or later than the 45th day
6772 after the date the election is ordered.
6873 (e) If a runoff election is necessary, it must be held on a
6974 Tuesday [or Saturday] occurring not earlier than the 12th day or
7075 later than the 25th day after the date the election is ordered.
7176 SECTION 8. The following provisions of the Election Code
7277 are repealed:
7378 (1) Section 41.001(d);
7479 (2) Section 41.0052(a-1), as added by Chapter 1160
7580 (S.B. 1131), Acts of the 88th Legislature, Regular Session, 2023;
7681 (3) Section 41.0052(a-1), as added by Chapter 985
7782 (S.B. 2620), Acts of the 88th Legislature, Regular Session, 2023;
7883 and
7984 (4) Section 85.001(e).
8085 SECTION 9. This Act takes effect September 1, 2025.
