88 relating to consolidating certain nonresident hunting licenses.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 41.003(b), Parks and Wildlife Code, is
1111 amended to read as follows:
1212 (b) An agreement must provide that a resident of the border
1313 state who has a sport fishing license or a hunting license issued by
1414 the border state may fish or hunt migratory waterfowl on rivers and
1515 lakes of the common border, and a Texas resident holding a Texas
1616 license is extended equal privileges. A person who holds a
1717 nonresident sport fishing license or a nonresident general hunting
1818 license issued by this state or a border state may be extended the
1919 same privileges as those extended a resident license holder under
2020 this subsection.
2121 SECTION 2. Sections 42.005(a), (b), and (e), Parks and
2222 Wildlife Code, are amended to read as follows:
2323 (a) No nonresident in this state may hunt a mule deer,
2424 white-tailed deer, turkey, pronghorn antelope, [or] desert bighorn
2525 sheep, or alligator in this state without first having acquired a
2626 nonresident general [nonresident] hunting license.
2727 (b) Except as provided by Subsection (f), no nonresident may
2828 hunt any bird or animal in this state without first having acquired
2929 a nonresident general [nonresident] hunting license[, a
3030 nonresident special hunting license,] or a nonresident five-day
3131 [special] hunting license.
3232 (e) A nonresident may not acquire or possess during a
3333 license year[:
3434 [(1)] more than one nonresident general [spring
3535 turkey] hunting license[; or
3636 [(2) a general nonresident hunting license and a
3737 nonresident spring turkey hunting license].
3838 SECTION 3. Section 42.0141, Parks and Wildlife Code, is
3939 amended to read as follows:
4040 Sec. 42.0141. NONRESIDENT GENERAL [NONRESIDENT] HUNTING
4141 LICENSE FEE. The fee for a nonresident general [nonresident]
4242 hunting license is $100.75 or an amount set by the commission,
4343 whichever amount is more.
4444 SECTION 4. Section 42.0143, Parks and Wildlife Code, is
4545 amended to read as follows:
4646 Sec. 42.0143. NONRESIDENT FIVE-DAY [SPECIAL] HUNTING
4747 LICENSE. (a) A nonresident five-day hunting license is not valid
4848 for a mule deer, white-tailed deer, turkey, pronghorn antelope,
4949 desert bighorn sheep, or alligator.
5050 (b) A nonresident five-day [special] hunting license is
5151 valid for five consecutive days.
5252 (c) A nonresident may acquire multiple nonresident five-day
5353 hunting licenses during a license year.
5454 (d) The fee for a nonresident five-day hunting [the] license
5555 is set by the commission in an amount not to exceed 50 percent of the
5656 amount of the fee set for a nonresident general [special] hunting
5757 license.
5858 SECTION 5. Section 42.0175(a), Parks and Wildlife Code, is
5959 amended to read as follows:
6060 (a) A license issued under this chapter, other than a
6161 lifetime resident hunting license or a nonresident five-day
6262 [special] hunting license, is valid only during the yearly period
6363 for which the license is issued without regard to the date on which
6464 a license is acquired. Each yearly period begins on September 1 or
6565 on another date set by the commission and extends through August 31
6666 of the next year or another date set by the commission. A license
6767 issued under this chapter other than a nonresident five-day
6868 [special] hunting license that is issued before September 1 or
6969 another date set by the commission and does not expire until August
7070 31 of the next year or another date set by the commission is valid
7171 from the date of issuance through August 31 of the following year or
7272 another date set by the commission. The commission by rule may set
7373 the amount of a license fee for a license issued during a transition
7474 period at an amount lower than prescribed in this chapter and
7575 provide for a license term for a transition period that is shorter
7676 or longer than a year.
7777 SECTION 6. Section 42.022(c), Parks and Wildlife Code, is
7878 amended to read as follows:
7979 (c) This section does not apply to the acquisition and
8080 possession by a nonresident of more than one nonresident hunting
8181 license if the nonresident does not acquire or possess during a
8282 license year[:
8383 [(1)] more than one nonresident[:
8484 [(A)] general hunting license[; or
8585 [(B) spring turkey hunting license; or
8686 [(2) both a nonresident general hunting license and a
8787 nonresident spring turkey hunting license].
8888 SECTION 7. The following provisions of the Parks and
8989 Wildlife Code are repealed:
9090 (1) Section 42.005(d);
9191 (2) Section 42.014;
9292 (3) Section 42.0142; and
9393 (4) Section 42.0144.
9494 SECTION 8. This Act takes effect September 1, 2025.
