711 A BILL TO BE ENTITLED
812 AN ACT
913 relating to the provision by a political subdivision of credits
1014 against impact fees to builders and developers for certain water
1115 conservation and reuse projects.
1216 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1317 SECTION 1. Subchapter B, Chapter 395, Local Government
1418 Code, is amended by adding Section 395.0231 to read as follows:
1519 Sec. 395.0231. CONSERVATION AND REUSE CREDITS AGAINST WATER
1620 AND WASTEWATER FEES. (a) A political subdivision shall provide a
1721 credit against water and wastewater impact fees otherwise assessed
1822 to a development to a builder or developer for the construction,
1923 contribution, or dedication of an eligible facility, system, or
2024 product that results in water reuse, conservation, or savings.
2125 (b) A facility, system, or product eligible for a credit
2226 under this section includes a facility, system, or product that:
2327 (1) reduces per service unit water consumption, supply
2428 requirements, or necessary treatment and distribution
2529 infrastructure per service unit;
2630 (2) decreases the need of wastewater collection and
2731 treatment facilities per service unit;
2832 (3) diminishes the demand for stormwater, drainage,
2933 and flood control facilities per service unit; or
3034 (4) integrates practices or technologies that achieve
3135 water efficiency, reuse, or conservation performance that exceed
3236 standard compliance requirements.
3337 (c) A political subdivision that provides a credit under
3438 this section shall establish procedures for:
3539 (1) calculating and applying the credits in a fair and
3640 consistent manner; and
3741 (2) reviewing and approving credits under this
3842 section.
3943 SECTION 2. This Act takes effect September 1, 2025.
