| 12 | 16 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 17 | | SECTION 1. Subchapter B, Chapter 395, Local Government |
|---|
| 14 | 18 | | Code, is amended by adding Section 395.0231 to read as follows: |
|---|
| 15 | 19 | | Sec. 395.0231. CONSERVATION AND REUSE CREDITS AGAINST WATER |
|---|
| 16 | 20 | | AND WASTEWATER FEES. (a) A political subdivision shall provide a |
|---|
| 17 | 21 | | credit against water and wastewater impact fees otherwise assessed |
|---|
| 18 | 22 | | to a development to a builder or developer for the construction, |
|---|
| 19 | 23 | | contribution, or dedication of an eligible facility, system, or |
|---|
| 20 | 24 | | product that results in water reuse, conservation, or savings. |
|---|
| 21 | 25 | | (b) A facility, system, or product eligible for a credit |
|---|
| 22 | 26 | | under this section includes a facility, system, or product that: |
|---|
| 23 | 27 | | (1) reduces per service unit water consumption, supply |
|---|
| 24 | 28 | | requirements, or necessary treatment and distribution |
|---|
| 25 | 29 | | infrastructure per service unit; |
|---|
| 26 | 30 | | (2) decreases the need of wastewater collection and |
|---|
| 27 | 31 | | treatment facilities per service unit; |
|---|
| 28 | 32 | | (3) diminishes the demand for stormwater, drainage, |
|---|
| 29 | 33 | | and flood control facilities per service unit; or |
|---|
| 30 | 34 | | (4) integrates practices or technologies that achieve |
|---|
| 31 | 35 | | water efficiency, reuse, or conservation performance that exceed |
|---|
| 32 | 36 | | standard compliance requirements. |
|---|
| 33 | 37 | | (c) A political subdivision that provides a credit under |
|---|
| 34 | 38 | | this section shall establish procedures for: |
|---|
| 35 | 39 | | (1) calculating and applying the credits in a fair and |
|---|
| 36 | 40 | | consistent manner; and |
|---|
| 37 | 41 | | (2) reviewing and approving credits under this |
|---|
| 38 | 42 | | section. |
|---|
| 39 | 43 | | SECTION 2. This Act takes effect September 1, 2025. |
