69 A BILL TO BE ENTITLED
710 AN ACT
811 relating to the regulation of mold assessors and remediators.
912 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1013 SECTION 1. Section 1958.001(4), Occupations Code, is
1114 amended to read as follows:
1215 (4) "Mold" means any living or dead fungi or related
1316 products or parts, including spores and[,] hyphae[, and
1417 mycotoxins].
1518 SECTION 2. Section 1958.002(b), Occupations Code, is
1619 amended to read as follows:
1720 (b) This chapter does not apply to:
1821 (1) the following activities when not conducted for
1922 the purpose of mold assessment or mold remediation:
2023 (A) routine cleaning;
2124 (B) the diagnosis, repair, cleaning, or
2225 replacement of plumbing, heating, ventilation, air conditioning,
2326 electrical, or air duct systems or appliances;
2427 (C) commercial or residential real estate
2528 inspections; and
2629 (D) the incidental discovery or emergency
2730 containment of potential mold contamination during the conduct or
2831 performance of services listed in this subsection;
2932 (2) the repair, replacement, or cleaning of
3033 construction materials during the building phase of the
3134 construction of a structure;
3235 (3) the standard performance of custodial activities
3336 for, preventive maintenance of, and the routine assessment of
3437 property owned or operated by a governmental entity; [or]
3538 (4) a pest control inspection conducted by a person
3639 regulated under Chapter 1951; or
3740 (5) demolition of a structure after a fire or other
3841 disaster.
3942 SECTION 3. Section 1958.034, Occupations Code, is amended
4043 to read as follows:
4144 Sec. 1958.034. DUTIES. The advisory board may advise the
4245 commission and department on:
4346 (1) technical matters relevant to the administration
4447 of this chapter;
4548 (2) standards of [or] performance and work practices
4649 for mold assessment or remediation;
4750 (3) qualifications for the issuance or renewal of a
4851 license, including any training or continuing education; and
4952 (4) other issues affecting mold assessment and
5053 remediation.
5154 SECTION 4. Section 1958.102(b), Occupations Code, is
5255 repealed.
5356 SECTION 5. The change in law made by this Act applies only
5457 to conduct that occurs on or after the effective date of this Act.
5558 Conduct that occurs before the effective date of this Act is
5659 governed by the law in effect on the date the conduct occurred, and
5760 the former law is continued in effect for that purpose.
5861 SECTION 6. This Act takes effect September 1, 2025.
