137 A BILL TO BE ENTITLED
148 AN ACT
15- relating to contracting by public and private schools for the
16- provision of medication for respiratory distress and training in
17- administering that medication.
9+ relating to the provision of medication for respiratory distress in
10+ public and private schools.
1811 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
19- SECTION 1. Subchapter E, Chapter 38, Education Code, is
12+ SECTION 1. Section 38.211, Education Code, is amended by
13+ adding Subsection (b-1) and amending Subsection (c) to read as
14+ follows:
15+ (b-1) The commissioner of state health services or, if the
16+ commissioner is not a physician, the chief medical executive of the
17+ Department of State Health Services may issue a statewide standing
18+ order prescribing medication for respiratory distress to a school
19+ district, open-enrollment charter school, or private school.
20+ (c) The standing order under Subsection (b) or (b-1) is not
21+ required to be patient-specific, and the epinephrine auto-injector
22+ or medication for respiratory distress may be administered to a
23+ person without a previously established physician-patient
24+ relationship.
25+ SECTION 2. Subchapter E, Chapter 38, Education Code, is
2026 amended by adding Section 38.2115 to read as follows:
2127 Sec. 38.2115. CONTRACTING FOR MEDICATION FOR RESPIRATORY
2228 DISTRESS AND TRAINING. The board of trustees of a school district
2329 or governing body of an open-enrollment charter school or private
2430 school may contract with a vendor to provide:
2531 (1) medication for respiratory distress and related
2632 equipment to the district or school; and
2733 (2) training to school personnel and school volunteers
2834 authorized to administer medication for respiratory distress under
2935 this subchapter.
30- SECTION 2. This Act takes effect immediately if it receives

3137 a vote of two-thirds of all the members elected to each house, as
3238 provided by Section 39, Article III, Texas Constitution. If this
3339 Act does not receive the vote necessary for immediate effect, this
