611 A BILL TO BE ENTITLED
712 AN ACT
813 relating to billing and reimbursement for certain medical
914 equipment, devices, and supplies provided to Medicare enrollees;
1015 creating a criminal offense.
1116 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1217 SECTION 1. Subtitle C, Title 5, Insurance Code, is amended
1318 by adding Chapter 566 to read as follows:
1419 CHAPTER 566. BILLING FOR CERTAIN MEDICAL EQUIPMENT, DEVICES, AND
1520 SUPPLIES
1621 SUBCHAPTER A. GENERAL PROVISIONS
1722 Sec. 566.001. DEFINITIONS. In this chapter:
1823 (1) "Assignment" means an agreement in which a
1924 supplier agrees to accept the Medicare-approved amount as payment
2025 for medical equipment or a medical device or supply.
2126 (2) "Durable medical equipment" means medical
2227 equipment that:
2328 (A) can withstand repeated use;
2429 (B) is expected to last at least three years;
2530 (C) is primarily and customarily used to serve a
2631 medical purpose;
2732 (D) is generally not useful in the absence of an
2833 illness or injury; and
2934 (E) is appropriate for use in the home.
3035 (3) "Enrollee" means an individual enrolled in
3136 Medicare.
3237 (4) "Medicare" means the health benefit coverage
3338 provided under the Health Insurance for the Aged Act (42 U.S.C.
3439 Section 1395 et seq.).
3540 (5) "Nonparticipating supplier" means an entity or
3641 person who:
3742 (A) provides Medicare-covered durable medical
3843 equipment, orthotic devices or supplies, or prosthetic devices or
3944 supplies to Medicare enrollees; and
4045 (B) is not enrolled in Medicare as a
4146 participating supplier.
4247 (6) "Orthotic device or supply" means:
4348 (A) a custom-fitted or custom-fabricated medical
4449 device designed to correct a deformity, improve function, or
4550 relieve symptoms of a disease; or
4651 (B) a medical supply related to a device
4752 described by Paragraph (A).
4853 (7) "Prosthetic device or supply" means:
4954 (A) an artificial medical device designed to
5055 replace all or part of a limb or internal organ; or
5156 (B) a medical supply related to a device
5257 described by Paragraph (A).
5358 SUBCHAPTER B. REGULATION OF CERTAIN BILLING PRACTICES
5459 Sec. 566.051. LIMITATIONS ON BILLING; NOTICE. (a) A
5560 nonparticipating supplier may not charge an enrollee more than 115
5661 percent of the Medicare-approved amount for durable medical
5762 equipment, orthotic devices or supplies, or prosthetic devices or
5863 supplies covered under Medicare for which the supplier has not
5964 accepted written assignment unless:
6065 (1) before the enrollee is billed, the enrollee agrees
6166 in writing to pay the additional amount; and
6267 (2) before receiving the durable medical equipment,
6368 orthotic device or supply, or prosthetic device or supply, the
6469 enrollee:
6570 (A) enters into a rental payment plan; or
6671 (B) pays the additional amount in full.
6772 (b) A written agreement between a nonparticipating supplier
6873 and enrollee under this section must provide notice to the enrollee
6974 that:
7075 (1) Medicare will reimburse 80 percent of the
7176 Medicare-approved amount for durable medical equipment, orthotic
7277 devices or supplies, or prosthetic devices or supplies covered
7378 under Medicare; and
7479 (2) a Medicare supplement benefit plan issuer is not
7580 required to reimburse the nonparticipating supplier or enrollee for
7681 the amount by which the charge exceeds 115 percent of the
7782 Medicare-approved amount.
7883 SUBCHAPTER C. ENFORCEMENT
7984 Sec. 566.101. APPLICATION OF DECEPTIVE TRADE PRACTICES LAW.
8085 A nonparticipating supplier who violates this chapter engages in a
8186 false, misleading, or deceptive act or practice under Section
8287 17.46, Business & Commerce Code.
8388 Sec. 566.102. CRIMINAL OFFENSE. (a) A nonparticipating
8489 supplier who intentionally violates this chapter commits an
8590 offense.
8691 (b) An offense under this section is a misdemeanor
8792 punishable by a fine of not less than $500 or more than $1,000.
8893 (c) Notwithstanding any other law, an offense under this
8994 section may be prosecuted in:
9095 (1) Travis County; or
9196 (2) a county in which prosecution is authorized under
9297 the Code of Criminal Procedure.
9398 SECTION 2. Subchapter B, Chapter 1652, Insurance Code, is
9499 amended by adding Section 1652.059 to read as follows:
95100 Sec. 1652.059. REIMBURSEMENT FOR CERTAIN MEDICAL
96101 EQUIPMENT, DEVICES, AND SUPPLIES. (a) In this section, terms
97102 defined by Section 566.001 have the meanings assigned by that
98103 section.
99104 (b) A Medicare supplement benefit plan issuer is not
100105 required to reimburse an enrollee or nonparticipating supplier for
101106 the amount by which a charge for durable medical equipment,
102107 orthotic devices or supplies, or prosthetic devices or supplies
103108 exceeds 115 percent of the Medicare-allowed amount for the
104109 equipment, device, or supply.
105110 (c) This section does not prohibit a Medicare supplement
106111 benefit plan issuer and a nonparticipating supplier from
107112 negotiating a level and type of reimbursement for durable medical
108113 equipment or orthotic or prosthetic devices or supplies.
109114 SECTION 3. Chapter 566, Insurance Code, as added by this
110115 Act, applies only to durable medical equipment or orthotic or
111116 prosthetic devices or supplies sold on or after the effective date
112117 of this Act.
113118 SECTION 4. This Act takes effect September 1, 2025.
