1110 establishments.
1211 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1312 SECTION 1. Chapter 437, Health and Safety Code, is amended
1413 by adding Section 437.029 to read as follows:
1514 Sec. 437.029. PROHIBITED LOCAL REGULATIONS RELATING TO
1615 CERTAIN LATE-NIGHT AND OVERNIGHT DELIVERIES TO FOOD SERVICE
1716 ESTABLISHMENTS. Notwithstanding any other law, the department, a
1817 county, a municipality, or a public health district may not require
1918 a food service establishment to obtain a sound regulation permit,
2019 charge a sound regulation fee to an establishment, or otherwise
2120 prohibit sound-related activity at an establishment for sound
2221 arising from the delivery of food, nonalcoholic beverages, food
2322 service supplies, or ice to the establishment if the establishment
2423 accepts delivery of those items for one hour or less between 10 p.m.
2524 and 5 a.m., provided the sound level from the deliveries does not
2625 exceed 65 dBA when measured from the residential property closest
2726 in proximity to the establishment, excluding traffic and other
2827 background noise that can be reasonably excluded.
2928 SECTION 2. This Act takes effect September 1, 2025.
