77 AN ACT
88 relating to an emergency preparedness and contingency operations
99 plan, including temperature regulation, for nursing facility and
1010 assisted living facility residents during an emergency; providing
1111 penalties.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter K, Chapter 242, Health and Safety
1414 Code, is amended by adding Section 242.405 to read as follows:
1515 Sec. 242.405. EMERGENCY PREPAREDNESS AND CONTINGENCY
1616 OPERATIONS PLAN; TEMPERATURE REGULATION. (a) In this section:
1717 (1) "Area of refuge" means a climate-controlled area
1818 of a nursing facility that is designated for use during a power
1919 outage or other emergency to provide safety, care, and other
2020 resources to residents.
2121 (2) "Bedfast resident" means a resident who is unable
2222 to transfer out of bed and unable to turn and position themselves in
2323 bed.
2424 (b) A nursing facility shall adopt and implement an
2525 emergency preparedness and contingency operations plan that
2626 requires the facility to provide in an emergency:
2727 (1) for each resident other than a bedfast resident, a
2828 climate-controlled area of refuge with at least 15 square feet per
2929 resident;
3030 (2) for each bedfast resident, a climate-controlled
3131 room; and
3232 (3) notice to the commission of an unplanned
3333 interruption or loss for more than 12 hours of electric utility
3434 service.
3535 (c) An emergency preparedness and contingency operations
3636 plan adopted in accordance with this section must require a nursing
3737 facility to maintain a temperature between 68 and 82 degrees
3838 Fahrenheit for:
3939 (1) each area of refuge designated for facility
4040 residents; and
4141 (2) each climate-controlled room for bedfast
4242 residents.
4343 (d) The executive commissioner shall adopt rules to enforce
4444 this section.
4545 (e) A nursing facility shall submit the emergency
4646 preparedness and contingency operations plan required by this
4747 section to the commission in the form and manner prescribed by the
4848 commission.
4949 (f) A nursing facility shall include in the emergency
5050 preparedness and contingency operations plan adopted in accordance
5151 with this section its policies and information on:
5252 (1) building equipment, including the location of and
5353 type of on-site generator equipment or backup power source; and
5454 (2) residents, including residents who are bedfast and
5555 residents who are dependent on electrically powered equipment.
5656 (g) The commission shall assess a penalty in accordance with
5757 Subchapter C against a nursing facility found in violation of this
5858 section.
5959 SECTION 2. Subchapter D, Chapter 247, Health and Safety
6060 Code, is amended by adding Section 247.073 to read as follows:
6161 Sec. 247.073. EMERGENCY PREPAREDNESS AND CONTINGENCY
6262 OPERATIONS PLAN; TEMPERATURE REGULATION. (a) In this section:
6363 (1) "Area of refuge" means a climate-controlled area
6464 in an assisted living facility that is designated for use during a
6565 power outage or other emergency to provide safety, care, and other
6666 resources to residents.
6767 (2) "Bedfast resident" means an assisted living
6868 facility resident who is unable to transfer out of bed and unable to
6969 turn and position themselves in bed.
7070 (b) An assisted living facility shall adopt and implement an
7171 emergency preparedness and contingency operations plan that
7272 requires the facility to provide in an emergency:
7373 (1) for each assisted living facility resident other
7474 than a bedfast resident, a climate-controlled area of refuge with
7575 at least 15 square feet per resident;
7676 (2) for each bedfast assisted living facility
7777 resident, a climate-controlled room; and
7878 (3) notice to the commission of an unplanned
7979 interruption or loss for more than 12 hours of electric utility
8080 service.
8181 (c) An emergency preparedness and contingency operations
8282 plan adopted in accordance with this section must require an
8383 assisted living facility to maintain a temperature between 68 and
8484 82 degrees Fahrenheit for:
8585 (1) each area of refuge designated for assisted living
8686 facility residents; and
8787 (2) each climate-controlled room for bedfast assisted
8888 living facility residents.
8989 (d) The executive commissioner shall adopt rules to enforce
9090 this section.
9191 (e) The commission shall establish construction and
9292 licensure standards for assisted living facilities constructed
9393 after September 1, 2026, including standards for:
9494 (1) the integration of backup power systems or a
9595 connection point for a backup power system; and
9696 (2) the evacuation of assisted living facility
9797 residents in emergencies to other buildings on the same premises.
9898 (f) An assisted living facility shall submit the emergency
9999 preparedness and contingency operations plan required by this
100100 section to the commission in the form and manner prescribed by the
101101 commission.
102102 (g) An assisted living facility shall include in the
103103 emergency preparedness and contingency operations plan adopted in
104104 accordance with this section its policies and information on:
105105 (1) building equipment, including the location of and
106106 type of on-site generator equipment or backup power source; and
107107 (2) assisted living facility residents, including
108108 residents who are bedfast and residents who are dependent on
109109 electrically powered equipment.
110110 (h) The commission shall assess a penalty in accordance with
111111 Subchapter C against an assisted living facility found in violation
112112 of this section.
113113 SECTION 3. (a) Not later than January 1, 2026:
114114 (1) each nursing facility shall adopt and implement an
115115 emergency preparedness and contingency operations plan as required
116116 by Section 242.405, Health and Safety Code, as added by this Act;
117117 and
118118 (2) each assisted living facility shall adopt and
119119 implement an emergency preparedness and contingency operations
120120 plan as required by Section 247.073, Health and Safety Code, as
121121 added by this Act.
122122 (b) Notwithstanding Sections 242.405 and 247.073, Health
123123 and Safety Code, as added by this Act, a nursing facility or
124124 assisted living facility is not subject to assessment of a penalty
125125 for a violation of those sections until on or after January 1, 2027.
126126 SECTION 4. This Act takes effect September 1, 2025.
