611 A BILL TO BE ENTITLED
712 AN ACT
813 relating to prohibiting the adoption or use of national sex
914 education standards in public schools.
1015 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1116 SECTION 1. Sections 28.002(b-1), (b-2), and (b-4),
1217 Education Code, are amended to read as follows:
1318 (b-1) In this section:
1419 (1) "Common[, "common] core state standards" means the
1520 national curriculum standards developed by the Common Core State
1621 Standards Initiative.
1722 (2) "National sex education standards" means national
1823 standards for instruction in human sexuality or sexually
1924 transmitted diseases, including standards developed by the Future
2025 of Sex Education Initiative.
2126 (b-2) The State Board of Education may not adopt common core
2227 state standards or national sex education standards to comply with
2328 a duty imposed under this chapter.
2429 (b-4) Notwithstanding any other provision of this code, a
2530 school district or open-enrollment charter school may not be
2631 required to offer any aspect of a common core state standards
2732 curriculum or any aspect of the national sex education standards.
2833 SECTION 2. Section 28.004(e), Education Code, is amended to
2934 read as follows:
3035 (e) Any course materials and instruction relating to human
3136 sexuality, sexually transmitted diseases, or human
3237 immunodeficiency virus or acquired immune deficiency syndrome
3338 shall be selected by the board of trustees with the advice of the
3439 local school health advisory council and:
3540 (1) must:
3641 (A) [(1)] present abstinence from sexual
3742 activity as the preferred choice of behavior in relationship to all
3843 sexual activity for unmarried persons of school age;
3944 (B) [(2)] devote more attention to abstinence
4045 from sexual activity than to any other behavior;
4146 (C) [(3)] emphasize that abstinence from sexual
4247 activity, if used consistently and correctly, is the only method
4348 that is 100 percent effective in preventing pregnancy, sexually
4449 transmitted diseases, infection with human immunodeficiency virus
4550 or acquired immune deficiency syndrome, and the emotional trauma
4651 associated with adolescent sexual activity;
4752 (D) [(4)] direct adolescents to a standard of
4853 behavior in which abstinence from sexual activity before marriage
4954 is the most effective way to prevent pregnancy, sexually
5055 transmitted diseases, and infection with human immunodeficiency
5156 virus or acquired immune deficiency syndrome; and
5257 (E) [(5)] teach contraception and condom use in
5358 terms of human use reality rates instead of theoretical laboratory
5459 rates, if instruction on contraception and condoms is included in
5560 curriculum content; and
5661 (2) may not be based on national sex education
5762 standards, as defined by Section 28.002(b-1).
5863 SECTION 3. This Act applies beginning with the 2025-2026
5964 school year.
6065 SECTION 4. This Act takes effect immediately if it receives
6166 a vote of two-thirds of all the members elected to each house, as
6267 provided by Section 39, Article III, Texas Constitution. If this
6368 Act does not receive the vote necessary for immediate effect, this
6469 Act takes effect September 1, 2025.
