69 A BILL TO BE ENTITLED
710 AN ACT
811 relating to third-party review of development documents and
912 inspection of improvements required to be approved by a political
1013 subdivision.
1114 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1215 SECTION 1. Section 247.002, Local Government Code, as added
1316 by Chapter 654 (H.B. 14), Acts of the 88th Legislature, Regular
1417 Session, 2023, is amended to read as follows:
1518 Sec. 247.002. THIRD-PARTY REVIEW OR INSPECTION REQUIRED.
1619 (a) If a regulatory authority does not approve, conditionally
1720 approve, or disapprove a development document, including a
1821 development permit, by the 15th day after the date prescribed by a
1922 provision of this code for the approval, conditional approval, or
2023 disapproval of the document, any required review of the document
2124 may be performed by a person:
2225 (1) other than:
2326 (A) the applicant; or
2427 (B) a person whose work is the subject of the
2528 application; and
2629 (2) who is:
2730 (A) employed by the regulatory authority to
2831 review development documents;
2932 (B) employed by another political subdivision to
3033 review development documents, if the regulatory authority has
3134 approved the person to review development documents; or
3235 (C) an engineer licensed under Chapter 1001,
3336 Occupations Code.
3437 (b) If a regulatory authority does not conduct a required
3538 development inspection by the 15th day after the date prescribed by
3639 a provision of this code for conducting the inspection, the
3740 inspection may be conducted by a person:
3841 (1) other than:
3942 (A) the owner of the land or improvement to the
4043 land that is the subject of the inspection; or
4144 (B) a person whose work is the subject of the
4245 inspection; and
4346 (2) who is:
4447 (A) certified [to inspect buildings] by the
4548 International Code Council;
4649 (B) employed by the regulatory authority as a
4750 building inspector;
4851 (C) employed by another political subdivision as
4952 a building inspector, if the regulatory authority has approved the
5053 person to perform inspections; or
5154 (D) an engineer licensed under Chapter 1001,
5255 Occupations Code.
5356 (c) A political subdivision is not liable for a review or
5457 inspection performed by a third party under this chapter.
5558 SECTION 2. Section 247.002(a), Local Government Code, as
5659 amended by this Act, and Section 247.002(c), Local Government Code,
5760 as added by this Act, are intended to clarify rather than change
5861 existing law.
5962 SECTION 3. This Act takes effect immediately if it receives
6063 a vote of two-thirds of all the members elected to each house, as
6164 provided by Section 39, Article III, Texas Constitution. If this
6265 Act does not receive the vote necessary for immediate effect, this
6366 Act takes effect September 1, 2025.
