11 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 15 | | SECTION 1. Section 247.002, Local Government Code, as added |
---|
13 | 16 | | by Chapter 654 (H.B. 14), Acts of the 88th Legislature, Regular |
---|
14 | 17 | | Session, 2023, is amended to read as follows: |
---|
15 | 18 | | Sec. 247.002. THIRD-PARTY REVIEW OR INSPECTION REQUIRED. |
---|
16 | 19 | | (a) If a regulatory authority does not approve, conditionally |
---|
17 | 20 | | approve, or disapprove a development document, including a |
---|
18 | 21 | | development permit, by the 15th day after the date prescribed by a |
---|
19 | 22 | | provision of this code for the approval, conditional approval, or |
---|
20 | 23 | | disapproval of the document, any required review of the document |
---|
21 | 24 | | may be performed by a person: |
---|
22 | 25 | | (1) other than: |
---|
23 | 26 | | (A) the applicant; or |
---|
24 | 27 | | (B) a person whose work is the subject of the |
---|
25 | 28 | | application; and |
---|
26 | 29 | | (2) who is: |
---|
27 | 30 | | (A) employed by the regulatory authority to |
---|
28 | 31 | | review development documents; |
---|
29 | 32 | | (B) employed by another political subdivision to |
---|
30 | 33 | | review development documents, if the regulatory authority has |
---|
31 | 34 | | approved the person to review development documents; or |
---|
32 | 35 | | (C) an engineer licensed under Chapter 1001, |
---|
33 | 36 | | Occupations Code. |
---|
34 | 37 | | (b) If a regulatory authority does not conduct a required |
---|
35 | 38 | | development inspection by the 15th day after the date prescribed by |
---|
36 | 39 | | a provision of this code for conducting the inspection, the |
---|
37 | 40 | | inspection may be conducted by a person: |
---|
38 | 41 | | (1) other than: |
---|
39 | 42 | | (A) the owner of the land or improvement to the |
---|
40 | 43 | | land that is the subject of the inspection; or |
---|
41 | 44 | | (B) a person whose work is the subject of the |
---|
42 | 45 | | inspection; and |
---|
43 | 46 | | (2) who is: |
---|
44 | 47 | | (A) certified [to inspect buildings] by the |
---|
45 | 48 | | International Code Council; |
---|
46 | 49 | | (B) employed by the regulatory authority as a |
---|
47 | 50 | | building inspector; |
---|
48 | 51 | | (C) employed by another political subdivision as |
---|
49 | 52 | | a building inspector, if the regulatory authority has approved the |
---|
50 | 53 | | person to perform inspections; or |
---|
51 | 54 | | (D) an engineer licensed under Chapter 1001, |
---|
52 | 55 | | Occupations Code. |
---|
53 | 56 | | (c) A political subdivision is not liable for a review or |
---|
54 | 57 | | inspection performed by a third party under this chapter. |
---|
55 | 58 | | SECTION 2. Section 247.002(a), Local Government Code, as |
---|
56 | 59 | | amended by this Act, and Section 247.002(c), Local Government Code, |
---|
57 | 60 | | as added by this Act, are intended to clarify rather than change |
---|
58 | 61 | | existing law. |
---|
59 | 62 | | SECTION 3. This Act takes effect immediately if it receives |
---|
60 | 63 | | a vote of two-thirds of all the members elected to each house, as |
---|
61 | 64 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
62 | 65 | | Act does not receive the vote necessary for immediate effect, this |
---|
63 | 66 | | Act takes effect September 1, 2025. |
