| 18 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 19 | 13 | | SECTION 1. Section 85.24, Education Code, is amended to |
|---|
| 20 | 14 | | read as follows: |
|---|
| 21 | 15 | | Sec. 85.24. UTILITIES. (a) The board [from time to time] |
|---|
| 22 | 16 | | may improve and equip existing [central] power plants and may |
|---|
| 23 | 17 | | construct, acquire, improve, and equip steam plants and additions |
|---|
| 24 | 18 | | to steam plants. For the purposes of this subsection, [them, and] |
|---|
| 25 | 19 | | the board may acquire property [land for these purposes] for the |
|---|
| 26 | 20 | | institutions under its control[,] when the total cost, type of |
|---|
| 27 | 21 | | construction, capacity, and plans and specifications have been |
|---|
| 32 | 25 | | (b) The board [from time to time] may construct, extend, and |
|---|
| 33 | 26 | | improve the water systems and [,] sewer systems[, or both,] for [any |
|---|
| 34 | 27 | | or] all institutions under its control[,] when the total cost, type |
|---|
| 35 | 28 | | of construction, capacity, and plans and specifications have been |
|---|
| 36 | 29 | | approved by the board. |

| 37 | 30 | | (c) The board may provide [furnish] water, sewer, steam, |
|---|
| 38 | 31 | | power, electricity, or any combination [or all] of those services |
|---|
| 39 | 32 | | from the [power and steam plant or] plants and other facilities |
|---|
| 40 | 33 | | located at each institution to [any or] all [dormitories, kitchens |
|---|
| 41 | 34 | | and dining halls, hospitals, student activity buildings, |
|---|
| 42 | 35 | | gymnasiums, athletic buildings and stadiums, the dormitory for |
|---|
| 43 | 36 | | help, laundry, and other] buildings or facilities that [may] have |
|---|
| 44 | 37 | | been or may be constructed at each institution, and may determine |
|---|
| 45 | 38 | | the amount to be charged as a part of the maintenance and operation |
|---|
| 46 | 39 | | expense of those buildings or facilities for the service or |
|---|
| 47 | 40 | | services. The board may allocate the cost of providing |
|---|
| 48 | 41 | | [furnishing] the services to revenue-producing buildings and |
|---|
| 49 | 42 | | facilities and to other buildings and facilities at the |
|---|
| 50 | 43 | | institutions. The board may pledge the net revenues from the |
|---|
| 51 | 44 | | amounts thus received for the services to pay the principal of and |
|---|
| 52 | 45 | | interest on, and to create and maintain the reserve for, the |
|---|
| 53 | 46 | | negotiable revenue bonds issued for the purpose of constructing, |
|---|
| 54 | 47 | | acquiring, improving, extending, or equipping the power and steam |
|---|
| 55 | 48 | | plants, or additions thereto, or other facilities, and may secure |
|---|
| 56 | 49 | | the bonds additionally by pledging rentals, rates, charges, and |
|---|
| 57 | 50 | | fees for the use or availability of all or any property, buildings, |
|---|
| 58 | 51 | | structures, activities, operations, or facilities, of any nature, |
|---|
| 59 | 52 | | which may be fixed and collected from all or any designated part of |
|---|
| 60 | 53 | | the students enrolled in the institution or institutions or from |
|---|
| 61 | 54 | | others in the amounts and in the manner determined and provided by |
|---|
| 62 | 55 | | the board in the resolution authorizing the issuance of the bonds. |

| 63 | 56 | | (d) In addition to the authority granted to the board under |
|---|
| 64 | 57 | | Subsections (a) and (b), the board may construct and acquire power |
