711 A BILL TO BE ENTITLED
812 AN ACT
913 relating to the marketing and sale of catfish and similar fish by
1014 food service establishments, food service suppliers, wholesalers,
1115 distributors, and wholesale distributors; providing administrative
1216 and civil penalties.
1317 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1418 SECTION 1. Chapter 436, Health and Safety Code, is amended
1519 by adding Subchapter J to read as follows:
1620 SUBCHAPTER J. MARKETING AND SALE OF CATFISH AND FISH SIMILAR TO
1721 CATFISH
1822 Sec. 436.151. DEFINITIONS. In this subchapter:
1923 (1) "Catfish" means any species of the scientific
2024 family Ictaluridae that is caught or produced by the customary
2125 technique of aquaculture and fishing in freshwater sources in the
2226 United States or a territory of the United States. The term does
2327 not include any species of the scientific genus Pangasius, family
2428 Clariidae, or family Siluridae, including fish commonly known as
2529 basa, tra, and swai.
2630 (2) "Distributor" means a person who transports and
2731 delivers seafood from a food service supplier or wholesaler to a
2832 food service establishment.
2933 (3) "Food service establishment" has the meaning
3034 assigned by Section 437.001.
3135 (4) "Food service supplier" means a person who
3236 sources, processes, or packages seafood for commercial sale. The
3337 term includes a wholesaler, manufacturer, and seafood broker.
3438 (5) "Wholesale distributor" means a person who sells
3539 seafood exclusively to another business, such as a distributor or a
3640 food service establishment, without direct-to-consumer sales.
3741 (6) "Wholesaler" means a person who purchases seafood
3842 in bulk from a food service supplier and resells the food to a
3943 distributor or food service establishment.
4044 Sec. 436.152. REQUIREMENTS FOR FOOD SERVICE
4145 ESTABLISHMENTS, FOOD SERVICE SUPPLIERS, WHOLESALERS, DISTRIBUTORS,
4246 AND WHOLESALE DISTRIBUTORS. (a) A food service establishment,
4347 food service supplier, wholesaler, distributor, or wholesale
4448 distributor that offers a food product for sale may represent and
4549 identify the product as catfish only if the product contains
4650 catfish and does not contain another fish similar to catfish.
4751 (b) A food service establishment that offers for sale a food
4852 product containing a fish similar to catfish that is not catfish may
4953 not represent the product as catfish.
5054 (c) A food service supplier, wholesaler, distributor, or
5155 wholesale distributor that offers for sale a product containing a
5256 fish similar to catfish that is not catfish:
5357 (1) may not represent the product as catfish; and
5458 (2) shall ensure the species and country of origin of
5559 the fish contained in the product are conspicuously identified in
5660 the description of the product on the product's packaging or
5761 container.
5862 Sec. 436.153. ADMINISTRATIVE PENALTY; AFFIRMATIVE DEFENSE.
5963 (a) The department, a public health district, or a county that
6064 under Chapter 431 or 437 requires a food service establishment,
6165 food service supplier, wholesaler, distributor, or wholesale
6266 distributor to hold a license or permit to operate in this state may
6367 impose an administrative penalty against the license or permit
6468 holder for a violation of this subchapter or a rule adopted under
6569 this subchapter.
6670 (b) The department, public health district, or county, as
6771 applicable, shall determine the amount of the penalty imposed for
6872 the violation based on the seriousness of the conduct.
6973 (c) Each day a violation continues or occurs is a separate
7074 violation for purposes of imposing an administrative penalty under
7175 this section.
7276 (d) It is an affirmative defense to the imposition of an
7377 administrative penalty under this section that a food service
7478 establishment demonstrates the establishment in good faith
7579 believed the fish the establishment purchased and offered for sale
7680 was catfish.
7781 Sec. 436.154. CIVIL PENALTY; AFFIRMATIVE DEFENSE. (a) A
7882 food service establishment, food service supplier, wholesaler,
7983 distributor, or wholesale distributor that violates this
8084 subchapter or a rule adopted under this subchapter is liable for a
8185 civil penalty to this state, a public health district, or a county
8286 that under Chapter 431 or 437 requires a license or permit to
8387 operate in this state.
8488 (b) The court shall determine the amount of the penalty to
8589 be imposed based on the seriousness of the conduct.
8690 (c) Each day a violation continues or occurs is a separate
8791 violation for purposes of imposing a civil penalty under this
8892 section.
8993 (d) The attorney general, the district or county attorney
9094 for the county, or the municipal attorney of the municipality in
9195 which the violation is alleged to have occurred may bring an action
9296 to recover a civil penalty under this section.
9397 (e) It is an affirmative defense to liability in a civil
9498 action under this section that a food service establishment
9599 demonstrates the establishment in good faith believed the fish the
96100 establishment purchased and offered for sale was catfish.
97101 Sec. 436.155. REMEDIES NOT CUMULATIVE. A person may be
98102 subject to either an administrative penalty under Section 436.153
99103 or a civil penalty under Section 436.154 for a violation of this
100104 subchapter arising from the same conduct, but not both.
101105 SECTION 2. This Act takes effect September 1, 2025.
