| 15 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 16 | 12 | | SECTION 1. Section 38.017(a), Education Code, is amended to |
|---|
| 17 | 13 | | read as follows: |
|---|
| 18 | 14 | | (a) Each school district shall make available at each campus |
|---|
| 19 | 15 | | in the district at least one automated external defibrillator, as |
|---|
| 20 | 16 | | defined by Section 779.001, Health and Safety Code. A campus |
|---|
| 21 | 17 | | defibrillator must be readily available during any University |
|---|
| 22 | 18 | | Interscholastic League athletic competition held on the campus. In |
|---|
| 23 | 19 | | determining the placement of [location at which to store] a campus |
|---|
| 24 | 20 | | defibrillator, the principal of the campus shall consider the |
|---|
| 25 | 21 | | primary location on campus where students engage in athletic |
|---|
| 26 | 22 | | activities and place the defibrillator in a clearly marked and |
|---|
| 27 | 23 | | accessible location. An automated external defibrillator may not |
|---|
| 28 | 24 | | be placed in a locked case when students or school employees are |
|---|
| 29 | 25 | | regularly present on campus. |
|---|
| 30 | 26 | | SECTION 2. Not later than the first instructional day of the |
|---|
| 31 | 27 | | 2026-2027 school year, each public school to which Section 38.017, |
|---|
| 32 | 28 | | Education Code, as amended by this Act, applies shall make |
|---|
| 33 | 29 | | available automated external defibrillators as required by that |
|---|
| 34 | 30 | | section. |
|---|
| 35 | 31 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 36 | 32 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 37 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 38 | 34 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 39 | 35 | | Act takes effect September 1, 2025. |
