611 A BILL TO BE ENTITLED
712 AN ACT
813 relating to a grant program to fund certain railroad grade
914 separation projects.
1015 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1116 SECTION 1. Chapter 471, Transportation Code, is amended by
1217 adding Section 471.010 to read as follows:
1318 Sec. 471.010. GRANT PROGRAM FOR CERTAIN RAILROAD GRADE
1419 SEPARATION PROJECTS. (a) For the purpose of increasing public
1520 safety, enhancing economic development, and reducing traffic, the
1621 department shall establish and administer a program to award grants
1722 to political subdivisions of this state to fund:
1823 (1) rail-roadway grade separation projects that are
1924 located at intersections of railroads and public roadways that are
2025 not part of the state highway system; and
2126 (2) rail-pedestrian grade separation projects that
2227 are located at intersections of railroads and public pedestrian
2328 crossings.
2429 (b) Each grant awarded under this section must be approved
2530 by the commission. The commission may not approve a grant under
2631 this section unless the commission determines that at least 10
2732 percent of the total project costs will be provided by a source
2833 other than the state.
2934 (c) The department may fund the grant program under this
3035 section only from money appropriated by the legislature for that
3136 purpose and from gifts and grants, including grants from the
3237 federal government. The department may solicit and accept gifts
3338 and grants from any source for the purposes of this section. Money
3439 deposited to the credit of the state highway fund may not be used to
3540 fund a grant awarded under this section.
3641 (d) A political subdivision that receives a grant under this
3742 section shall designate the department to manage contracting for,
3843 in accordance with Subchapter A, Chapter 223, and supervision of
3944 the planning and construction of a project for which the grant was
4045 awarded. A political subdivision shall enter into an agreement
4146 with the department prescribing the terms of a designation under
4247 this subsection in accordance with applicable state or federal law.
4348 The department, acting as the designee of a political subdivision
4449 under this section, shall make each contract in accordance with the
4550 law governing the making of contracts by or on behalf of the state.
4651 (e) The commission shall adopt rules as necessary to
4752 implement this section.
4853 SECTION 2. Not later than October 1, 2025, the Texas
4954 Transportation Commission shall adopt the rules required by Section
5055 471.010, Transportation Code, as added by this Act.
5156 SECTION 3. This Act takes effect immediately if it receives
5257 a vote of two-thirds of all the members elected to each house, as
5358 provided by Section 39, Article III, Texas Constitution. If this
5459 Act does not receive the vote necessary for immediate effect, this
5560 Act takes effect September 1, 2025.
