77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to creating the criminal offense of trespass on or near
1010 school or day-care center property.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 30, Penal Code, is amended by adding
1313 Section 30.055 to read as follows:
1414 Sec. 30.055. TRESPASS ON OR NEAR SCHOOL OR DAY-CARE CENTER
1515 PROPERTY. (a) In this section:
1616 (1) "Day-care center" has the meaning assigned by
1717 Section 42.002, Human Resources Code.
1818 (2) "Public property" includes a street, highway,
1919 alley, public park, or sidewalk.
2020 (3) "School" means a private or public elementary or
2121 secondary school.
2222 (4) "School or day-care center property" means:
2323 (A) all land and buildings owned or leased by a
2424 school or day-care center; and
2525 (B) any grounds or buildings on which an activity
2626 sponsored by the school or day-care center is being conducted.
2727 (b) A person commits an offense if the person:
2828 (1) enters or remains on:
2929 (A) school or day-care center property; or
3030 (B) public property located within 250 feet of
3131 school or day-care center property;
3232 (2) either:
3333 (A) poses a substantial risk of harm to any
3434 person; or
3535 (B) on more than one occasion and pursuant to the
3636 same scheme or course of conduct, behaves in a manner that is
3737 inappropriate for a school or day-care center setting; and
3838 (3) receives a request to depart by an administrator,
3939 educator, or security personnel officer employed by the school or
4040 day-care center and fails to depart.
4141 (c) An offense under this section is a Class A misdemeanor.
4242 (d) If conduct constituting an offense under this section
4343 also constitutes an offense under another section of this code, the
4444 actor may be prosecuted under either section or both sections.
4545 SECTION 2. This Act takes effect September 1, 2025.
