77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to health benefit plan coverage of anxiety and pain
1010 management in connection with prescription contraceptive devices.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 1369.1031, Insurance Code, is amended by
1313 adding Subsections (e) and (f) to read as follows:
1414 (e) A health benefit plan that provides benefits for forms
1515 of contraception approved by the United States Food and Drug
1616 Administration must provide coverage of evidence-based anxiety and
1717 pain management related to the insertion and removal of
1818 contraception, including:
1919 (1) prescription antianxiety medication;
2020 (2) minimal and moderate sedation;
2121 (3) local anesthesia;
2222 (4) topical anesthetics; and
2323 (5) paracervical blocks.
2424 (f) The coverage described by Subsection (e) is not subject
2525 to a cost-sharing requirement, including a deductible or
2626 coinsurance, utilization review, or step therapy, or any other
2727 restriction or delay on coverage.
2828 SECTION 2. The change in law made by this Act applies only
2929 to a health benefit plan that is delivered, issued for delivery, or
3030 renewed on or after January 1, 2026.
3131 SECTION 3. This Act takes effect September 1, 2025.
