10 | 15 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 16 | | SECTION 1. Section 5003.051, Special District Local Laws |
---|
12 | 17 | | Code, is amended to read as follows: |
---|
13 | 18 | | Sec. 5003.051. BOARD OF NAVIGATION COMMISSIONERS. The port |
---|
14 | 19 | | authority is governed by a board of seven [six] commissioners. |
---|
15 | 20 | | SECTION 2. Section 5003.053, Special District Local Laws |
---|
16 | 21 | | Code, is amended to read as follows: |
---|
17 | 22 | | Sec. 5003.053. ELECTION; TERMS. (a) One commissioner is |
---|
18 | 23 | | elected by the voters of the entire port authority. One |
---|
19 | 24 | | commissioner is elected from each of the six navigation |
---|
20 | 25 | | commissioner precincts as described by Section 5003.052. |
---|
21 | 26 | | (b) The [six] commissioners who represent the six precincts |
---|
22 | 27 | | who are elected at the first election after a division of the port |
---|
23 | 28 | | authority into new precincts under Section 5003.052 shall draw lots |
---|
24 | 29 | | after the election to select three commissioners to serve two-year |
---|
25 | 30 | | terms and three commissioners to serve four-year terms. Successor |
---|
26 | 31 | | commissioners serve terms as provided by Subsection (c) [(b)]. |
---|
27 | 32 | | (c) [(b)] Except as provided by Subsection (b) [(a)], |
---|
28 | 33 | | commissioners are elected for staggered four-year terms at |
---|
29 | 34 | | elections held each odd-numbered year on the uniform election date |
---|
30 | 35 | | in May. |
---|
31 | 36 | | SECTION 3. Section 5003.054(b), Special District Local Laws |
---|
32 | 37 | | Code, is amended to read as follows: |

33 | 38 | | (b) The application must include an affidavit made by the |
---|
34 | 39 | | applicant under oath disclosing that the applicant is: |
---|
35 | 40 | | (1) a bona fide resident of: |
---|
36 | 41 | | (A) if the applicant seeks to represent a |
---|
37 | 42 | | precinct, the precinct that the person seeks to represent; or |
---|
38 | 43 | | (B) if the applicant seeks to represent the port |
---|
39 | 44 | | authority at large, the port authority; and |
---|
40 | 45 | | (2) a qualified voter who owns real property in the |
---|
41 | 46 | | area. |
---|
42 | 47 | | SECTION 4. (a) The Calhoun Port Authority shall hold the |
---|
43 | 48 | | first election to elect an at-large commissioner, as provided by |
---|
44 | 49 | | Section 5003.053, Special District Local Laws Code, as amended by |
---|
45 | 50 | | this Act, on the uniform election date in May 2027. |
---|
46 | 51 | | (b) Not later than the 30th day after the effective date of |
---|
47 | 52 | | this Act, the governor shall appoint an at-large commissioner to |
---|
48 | 53 | | the board of the Calhoun Port Authority to serve a term that expires |
---|
49 | 54 | | on the date that the candidate elected to the office of the at-large |
---|
50 | 55 | | commissioner in May 2027 qualifies to serve. The person appointed |
---|
51 | 56 | | by the governor must meet the qualifications provided by Section |
---|
52 | 57 | | 5003.054(b), Special District Local Laws Code, as amended by this |
---|
53 | 58 | | Act. |
---|
54 | 59 | | SECTION 5. (a) The legal notice of the intention to |
---|
55 | 60 | | introduce this Act, setting forth the general substance of this |
---|
56 | 61 | | Act, has been published as provided by law, and the notice and a |
---|
57 | 62 | | copy of this Act have been furnished to all persons, agencies, |
---|
58 | 63 | | officials, or entities to which they are required to be furnished |
---|
59 | 64 | | under Section 59, Article XVI, Texas Constitution, and Chapter 313, |
---|
60 | 65 | | Government Code. |
---|
61 | 66 | | (b) The governor, one of the required recipients, has |
---|
62 | 67 | | submitted the notice and Act to the Texas Commission on |
---|
63 | 68 | | Environmental Quality. |
---|
64 | 69 | | (c) The Texas Commission on Environmental Quality has filed |
---|
65 | 70 | | its recommendations relating to this Act with the governor, the |
---|
66 | 71 | | lieutenant governor, and the speaker of the house of |
---|
67 | 72 | | representatives within the required time. |
---|
68 | 73 | | (d) All requirements of the constitution and laws of this |
---|
69 | 74 | | state and the rules and procedures of the legislature with respect |
---|
70 | 75 | | to the notice, introduction, and passage of this Act are fulfilled |
---|
71 | 76 | | and accomplished. |
---|
72 | 77 | | SECTION 6. This Act takes effect immediately if it receives |
---|
73 | 78 | | a vote of two-thirds of all the members elected to each house, as |
---|
74 | 79 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
75 | 80 | | Act does not receive the vote necessary for immediate effect, this |
---|
76 | 81 | | Act takes effect September 1, 2025. |
