611 A BILL TO BE ENTITLED
712 AN ACT
813 relating to the composition of the board of the Calhoun Port
914 Authority.
1015 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1116 SECTION 1. Section 5003.051, Special District Local Laws
1217 Code, is amended to read as follows:
1318 Sec. 5003.051. BOARD OF NAVIGATION COMMISSIONERS. The port
1419 authority is governed by a board of seven [six] commissioners.
1520 SECTION 2. Section 5003.053, Special District Local Laws
1621 Code, is amended to read as follows:
1722 Sec. 5003.053. ELECTION; TERMS. (a) One commissioner is
1823 elected by the voters of the entire port authority. One
1924 commissioner is elected from each of the six navigation
2025 commissioner precincts as described by Section 5003.052.
2126 (b) The [six] commissioners who represent the six precincts
2227 who are elected at the first election after a division of the port
2328 authority into new precincts under Section 5003.052 shall draw lots
2429 after the election to select three commissioners to serve two-year
2530 terms and three commissioners to serve four-year terms. Successor
2631 commissioners serve terms as provided by Subsection (c) [(b)].
2732 (c) [(b)] Except as provided by Subsection (b) [(a)],
2833 commissioners are elected for staggered four-year terms at
2934 elections held each odd-numbered year on the uniform election date
3035 in May.
3136 SECTION 3. Section 5003.054(b), Special District Local Laws
3237 Code, is amended to read as follows:
3338 (b) The application must include an affidavit made by the
3439 applicant under oath disclosing that the applicant is:
3540 (1) a bona fide resident of:
3641 (A) if the applicant seeks to represent a
3742 precinct, the precinct that the person seeks to represent; or
3843 (B) if the applicant seeks to represent the port
3944 authority at large, the port authority; and
4045 (2) a qualified voter who owns real property in the
4146 area.
4247 SECTION 4. (a) The Calhoun Port Authority shall hold the
4348 first election to elect an at-large commissioner, as provided by
4449 Section 5003.053, Special District Local Laws Code, as amended by
4550 this Act, on the uniform election date in May 2027.
4651 (b) Not later than the 30th day after the effective date of
4752 this Act, the governor shall appoint an at-large commissioner to
4853 the board of the Calhoun Port Authority to serve a term that expires
4954 on the date that the candidate elected to the office of the at-large
5055 commissioner in May 2027 qualifies to serve. The person appointed
5156 by the governor must meet the qualifications provided by Section
5257 5003.054(b), Special District Local Laws Code, as amended by this
5358 Act.
5459 SECTION 5. (a) The legal notice of the intention to
5560 introduce this Act, setting forth the general substance of this
5661 Act, has been published as provided by law, and the notice and a
5762 copy of this Act have been furnished to all persons, agencies,
5863 officials, or entities to which they are required to be furnished
5964 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
6065 Government Code.
6166 (b) The governor, one of the required recipients, has
6267 submitted the notice and Act to the Texas Commission on
6368 Environmental Quality.
6469 (c) The Texas Commission on Environmental Quality has filed
6570 its recommendations relating to this Act with the governor, the
6671 lieutenant governor, and the speaker of the house of
6772 representatives within the required time.
6873 (d) All requirements of the constitution and laws of this
6974 state and the rules and procedures of the legislature with respect
7075 to the notice, introduction, and passage of this Act are fulfilled
7176 and accomplished.
7277 SECTION 6. This Act takes effect immediately if it receives
7378 a vote of two-thirds of all the members elected to each house, as
7479 provided by Section 39, Article III, Texas Constitution. If this
7580 Act does not receive the vote necessary for immediate effect, this
7681 Act takes effect September 1, 2025.
