14	8		AN ACT
15	9		relating to the name, rights, powers, and privileges of the Cedar
16	10		Port Navigation and Improvement District.
17	11		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
18	12		SECTION 1. The heading to Chapter 3854, Special District
19	13		Local Laws Code, is amended to read as follows:
20	14		CHAPTER 3854. CEDAR PORT NAVIGATION AND IMPROVEMENT DISTRICT
21	15		[CHAMBERS COUNTY IMPROVEMENT DISTRICT NO. 1]
22	16		SECTION 2. Section 3854.001(3), Special District Local Laws
23	17		Code, is amended to read as follows:
24	18		(3) "District" means the Cedar Port Navigation and
25	19		Improvement District [Chambers County Improvement District No. 1].
26	20		SECTION 3. Section 3854.002, Special District Local Laws
27	21		Code, is amended to read as follows:
28	22		Sec. 3854.002. NATURE OF DISTRICT. A special district
29	23		known as the "Cedar Port Navigation and Improvement District"
30	24		["Chambers County Improvement District No. 1"] is a political
31	25		subdivision of this state.
32	26		SECTION 4. Section 3854.151, Special District Local Laws
33	27		Code, is amended to read as follows:
34		-	Sec. 3854.151. GENERAL POWERS. The district has:

35	29		(1) all the rights, powers, and privileges conferred
36	30		by the general law of this state applicable to districts created

40	34		623, Acts of the 67th Legislature, Regular Session, 1981 (former
41	35		Article 6550c, Vernon's Texas Civil Statutes);
42	36		(C) Chapter 441, Transportation Code; and
43	37		(D) Chapters 49 and [Chapter] 54, Water Code;
44	38		(2) the rights, powers, and privileges granted to
45	39		districts by:
46	40		(A) [Subchapters E and M,] Chapter 60, Water
47	41		Code; and
48	42		(B) Sections [Section] 61.116 and 62.118, Water
49	43		Code; and
50	44		(3) all the powers granted to municipal management
51	45		districts under Sections 375.092 and 375.111, Local Government
52	46		Code, to provide any services or for any project the district is
53	47		authorized to acquire, construct, or improve under this chapter.
54		-	SECTION 5. Subchapter D, Chapter 3854, Special District
55		-	Local Laws Code, is amended by adding Section 3854.1515 to read as
56		-	follows:
57		-	Sec. 3854.1515. ACTING AS NONFEDERAL SPONSOR. If authorized
58		-	by the United States, notwithstanding Section 60.033, Water Code,
59		-	or any other state law, the district may exercise all rights,
60		-	powers, and privileges necessary to allow the district to act as a
61		-	nonfederal sponsor under a federal project partnership agreement,
62		-	including by operating barges, engaging in dredging, and engaging
63		-	in related maritime operations on water that is not in the territory
64		-	of the district.
65		-	SECTION 6. Section 3854.153, Special District Local Laws

68	53		district may acquire any interest in land in accordance with
69	54		Chapter 49, [Chapter] 54, or 60, Water Code.

80	65		(c) The Texas Commission on Environmental Quality has filed
81	66		its recommendations relating to this Act with the governor, the
82	67		lieutenant governor, and the speaker of the house of
83	68		representatives within the required time.
84	69		(d) All requirements of the constitution and laws of this
85	70		state and the rules and procedures of the legislature with respect
86	71		to the notice, introduction, and passage of this Act are fulfilled
87	72		and accomplished.
88		-	SECTION 8. This Act takes effect immediately if it receives
