77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a model suicide prevention policy, suicide prevention
1010 and intervention strategies incorporated into a state agency crisis
1111 or disaster plan, suicide death information maintained by the
1212 Department of State Health Services, and the Texas Violent Death
1313 Reporting System.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Chapter 547, Government Code, as effective April
1616 1, 2025, is amended by adding Subchapter J to read as follows:
1717 SUBCHAPTER J. SUICIDE PREVENTION
1818 Sec. 547.0451. MODEL SUICIDE PREVENTION POLICY. (a) In
1919 this section, "postvention" includes activities that promote
2020 healing necessary to reduce the risk of suicide by an individual
2121 affected by the suicide of another individual.
2222 (b) The commission shall develop and publish on the
2323 commission's Internet website a model suicide prevention policy to
2424 be implemented at state agencies, community coalitions, and other
2525 public or private institutions or facilities that serve populations
2626 at higher risk for suicide, including veterans, individuals with
2727 disabilities, and individuals who live in rural areas of this
2828 state. The policy must be designed for implementation by
2929 individuals who may not be mental health professionals.
3030 (c) The policy must include:
3131 (1) information on suicide prevention, intervention,
3232 and postvention;
3333 (2) information on recognizing warning signs of
3434 suicide; and
3535 (3) resources, including local mental health
3636 authorities, for individuals at risk of suicide.
3737 (d) The policy must address the development of community
3838 coalitions to engage in suicide prevention, intervention, and
3939 postvention activities, especially in high-risk rural areas of this
4040 state.
4141 (e) In developing the policy under this section, the
4242 commission:
4343 (1) shall collaborate with the statewide behavioral
4444 health coordinating council established under Subchapter D and the
4545 Texas Suicide Prevention Collaborative; and
4646 (2) may receive information or assistance from any
4747 other interested statewide or local entities engaged in suicide
4848 prevention, intervention, and postvention.
4949 Sec. 547.0452. CRISIS AND DISASTER PLANS. (a) Not later
5050 than August 31, 2026, the commission, in collaboration with the
5151 Disaster Behavioral Health Consortium, shall:
5252 (1) for the purpose of identifying opportunities to
5353 incorporate suicide prevention, intervention, and postvention
5454 strategies:
5555 (A) conduct a review of crisis plans and disaster
5656 plans of state agency consortium members; and
5757 (B) identify lessons learned from responses by
5858 state agency consortium members during prior crises or disasters;
5959 and
6060 (2) based on the information obtained under
6161 Subdivision (1), recommend to each state agency consortium member
6262 incorporating suicide prevention, intervention, and postvention
6363 strategies into a crisis plan or disaster plan.
6464 (b) Not later than August 1, 2027, each state agency member
6565 of the Disaster Behavioral Health Consortium shall incorporate
6666 recommendations the commission made under Subsection (a) into the
6767 agency's crisis plan or disaster plan.
6868 (c) This section expires September 1, 2027.
6969 SECTION 2. Section 191.002(b), Health and Safety Code, is
7070 amended to read as follows:
7171 (b) The department shall:
7272 (1) establish a vital statistics unit in the
7373 department with suitable offices that are properly equipped for the
7474 preservation of its official records;
7575 (2) establish a statewide system of vital statistics;
7676 (3) provide instructions and prescribe forms for
7777 collecting, recording, transcribing, compiling, and preserving
7878 vital statistics;
7979 (4) require the enforcement of this title and rules
8080 adopted under this title;
8181 (5) prepare, print, and supply to local registrars
8282 forms for registering, recording, and preserving returns or
8383 otherwise carrying out the purposes of this title; [and]
8484 (6) propose legislation necessary for the purposes of
8585 this title; and
8686 (7) provide access to information regarding suicides
8787 in this state to the statewide suicide prevention coordinator of
8888 the Health and Human Services Commission's office of mental health
8989 coordination.
9090 SECTION 3. Subchapter D, Chapter 1001, Health and Safety
9191 Code, is amended by adding Section 1001.090 to read as follows:
9292 Sec. 1001.090. TEXAS VIOLENT DEATH REPORTING SYSTEM. (a)
9393 The department shall establish and operate the Texas Violent Death
9494 Reporting System for the purpose of participating in the National
9595 Violent Death Reporting System operated by the Centers for Disease
9696 Control and Prevention.
9797 (b) The department shall provide access to suicide data
9898 obtained or maintained through the Texas Violent Death Reporting
9999 System to the statewide suicide prevention coordinator of the
100100 commission's office of mental health coordination.
101101 (c) The executive commissioner may adopt rules necessary to
102102 implement this section.
103103 SECTION 4. This Act takes effect immediately if it receives
104104 a vote of two-thirds of all the members elected to each house, as
105105 provided by Section 39, Article III, Texas Constitution. If this
106106 Act does not receive the vote necessary for immediate effect, this
107107 Act takes effect September 1, 2025.
