77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the provision of information regarding centers for
1010 independent living for certain persons with an intellectual or
1111 developmental disability.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter A, Chapter 29, Education Code, is
1414 amended by adding Section 29.0033 to read as follows:
1515 Sec. 29.0033. INTELLECTUAL OR DEVELOPMENTAL DISABILITY
1616 CARE INFORMATION. (a) In this section, "center for independent
1717 living" has the meaning assigned by Section 702 of the federal
1818 Rehabilitation Act of 1973 (29 U.S.C. Section 796a).
1919 (b) Each school district and open-enrollment charter school
2020 shall provide informational materials on centers for independent
2121 living to a parent or legal guardian whose child:
2222 (1) receives special education services under this
2323 subchapter; or
2424 (2) is covered by Section 504 of the federal
2525 Rehabilitation Act of 1973 (29 U.S.C. Section 794).
2626 (c) The Health and Human Services Commission, in
2727 collaboration with the agency, shall develop and provide the agency
2828 the informational materials required to be provided to parents or
2929 legal guardians under Subsection (b). The materials must include:
3030 (1) a description of the health care and other
3131 services available to persons with an intellectual or developmental
3232 disability through a center for independent living; and
3333 (2) the contact information for centers of independent
3434 living in this state.
3535 (d) The agency shall make the materials developed under this
3636 section available to school districts and open-enrollment charter
3737 schools.
3838 SECTION 2. Section 161.501(a), Health and Safety Code, is
3939 amended to read as follows:
4040 (a) A hospital, birthing center, physician, nurse midwife,
4141 or midwife who provides prenatal care to a pregnant woman during
4242 gestation or at delivery of an infant shall:
4343 (1) provide the woman and the father of the infant, if
4444 possible, or another adult caregiver for the infant, with a
4545 resource pamphlet that includes:
4646 (A) a list of the names, addresses, and phone
4747 numbers of professional organizations that provide postpartum
4848 counseling and assistance to parents relating to postpartum
4949 depression and other emotional trauma associated with pregnancy and
5050 parenting;
5151 (B) information regarding the prevention of
5252 shaken baby syndrome including:
5353 (i) techniques for coping with anger caused
5454 by a crying baby;
5555 (ii) different methods for preventing a
5656 person from shaking a newborn, infant, or other young child;
5757 (iii) the dangerous effects of shaking a
5858 newborn, infant, or other young child; and
5959 (iv) the symptoms of shaken baby syndrome
6060 and who to contact, as recommended by the American Academy of
6161 Pediatrics, if a parent suspects or knows that a baby has been
6262 shaken in order to receive prompt medical treatment;
6363 (C) a list of diseases for which a child is
6464 required by state law to be immunized and the appropriate schedule
6565 for the administration of those immunizations;
6666 (D) the appropriate schedule for follow-up
6767 procedures for newborn screening;
6868 (E) information regarding sudden infant death
6969 syndrome, including current recommendations for infant sleeping
7070 conditions to lower the risk of sudden infant death syndrome;
7171 (F) educational information in both English and
7272 Spanish on:
7373 (i) pertussis disease and the availability
7474 of a vaccine to protect against pertussis, including information on
7575 the Centers for Disease Control and Prevention recommendation that
7676 parents receive Tdap during the postpartum period to protect
7777 newborns from the transmission of pertussis; and
7878 (ii) the incidence of cytomegalovirus,
7979 birth defects caused by congenital cytomegalovirus, and available
8080 resources for the family of an infant born with congenital
8181 cytomegalovirus; and
8282 (G) the danger of heatstroke for a child left
8383 unattended in a motor vehicle;
8484 (2) if the woman is a recipient of medical assistance
8585 under Chapter 32, Human Resources Code, provide the woman and the
8686 father of the infant, if possible, or another adult caregiver with a
8787 resource guide that includes information in both English and
8888 Spanish relating to the development, health, and safety of a child
8989 from birth until age five, including information relating to:
9090 (A) selecting and interacting with a primary
9191 health care practitioner and establishing a "medical home" for the
9292 child;
9393 (B) dental care;
9494 (C) effective parenting;
9595 (D) child safety;
9696 (E) the importance of reading to a child;
9797 (F) expected developmental milestones;
9898 (G) health care resources available in the state;
9999 (H) selecting appropriate child care; and
100100 (I) other resources available in the state;
101101 (3) if the infant is born with an intellectual or
102102 developmental disability, provide the woman and the father of the
103103 infant, if possible, or another adult caregiver of the infant with a
104104 resource guide on centers for independent living as defined by
105105 Section 702 of the federal Rehabilitation Act of 1973 (29 U.S.C.
106106 Section 796a) and the services provided by the centers for a child
107107 with an intellectual or developmental disability;
108108 (4) document in the woman's record that the woman
109109 received the resource pamphlet described in Subdivision (1) and the
110110 resource guide described in Subdivision (2) or (3), if applicable;
111111 and
112112 (5) [(4)] retain the documentation for at least five
113113 years in the hospital's, birthing center's, physician's, nurse
114114 midwife's, or midwife's records.
115115 SECTION 3. Subtitle E, Title 7, Health and Safety Code, is
116116 amended by adding Chapter 616 to read as follows:
117117 CHAPTER 616. INTELLECTUAL OR DEVELOPMENTAL DISABILITY CARE
118118 INFORMATION
119119 Sec. 616.001. DEFINITION. In this section, "center for
120120 independent living" has the meaning assigned by Section 702 of the
121121 federal Rehabilitation Act of 1973 (29 U.S.C. Section 796a).
122122 Sec. 616.002. PROVISION OF INFORMATION TO PERSON DIAGNOSED
123123 WITH INTELLECTUAL OR DEVELOPMENTAL DISABILITY. (a) A health care
124124 provider who diagnoses an individual with an intellectual or
125125 developmental disability shall provide the individual and, if
126126 appropriate, the individual's parent, managing conservator,
127127 guardian, or caregiver informational materials on centers for
128128 independent living described by Subsection (b).
129129 (b) The Health and Human Services Commission shall develop
130130 informational materials regarding centers for independent living
131131 and post the materials on the commission's Internet website. The
132132 informational materials must include:
133133 (1) a description of the health care and other
134134 services available to persons with an intellectual or developmental
135135 disability through a center for independent living; and
136136 (2) the contact information for centers of independent
137137 living in this state.
138138 SECTION 4. (a) Not later than December 1, 2025, the Health
139139 and Human Services Commission shall develop and make available the
140140 informational materials required by Section 29.0033, Education
141141 Code, as added by this Act, and Section 616.002, Health and Safety
142142 Code, as added by this Act.
143143 (b) Notwithstanding Section 29.0033, Education Code, as
144144 added by this Act, or Section 616.002, Health and Safety Code, as
145145 added by this Act, a school district, open-enrollment charter
146146 school, or health care provider is not required to comply with those
147147 provisions until January 1, 2026.
148148 SECTION 5. (a) Not later than December 1, 2025, the
149149 Department of State Health Services shall develop the resource
150150 guide on centers for independent living required to be provided
151151 under Section 161.501(a), Health and Safety Code, as amended by
152152 this Act.
153153 (b) Notwithstanding the change in law made by this Act to
154154 Section 161.501(a), Health and Safety Code, a hospital, birthing
155155 center, physician, nurse midwife, or midwife who provides prenatal
156156 care to a pregnant woman during gestation or delivery of an infant
157157 is not required to provide the resource guide on centers for
158158 independent living until January 1, 2026.
159159 SECTION 6. This Act takes effect September 1, 2025.
