| 11 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 11 | | SECTION 1. Section 15.531(2), Water Code, is amended to |
|---|
| 13 | 12 | | read as follows: |
|---|
| 14 | 13 | | (2) "Flood project" means a drainage, flood |
|---|
| 15 | 14 | | mitigation, or flood control project, including: |
|---|
| 16 | 15 | | (A) planning and design activities; |
|---|
| 17 | 16 | | (B) work to obtain regulatory approval to provide |
|---|
| 18 | 17 | | nonstructural and structural flood mitigation and drainage; |
|---|
| 19 | 18 | | (C) construction of structural flood mitigation |
|---|
| 20 | 19 | | and drainage infrastructure; [and] |
|---|
| 21 | 20 | | (D) construction and implementation of |
|---|
| 22 | 21 | | nonstructural projects, including projects that use nature-based |
|---|
| 23 | 22 | | features to protect, mitigate, or reduce flood risk; and |
|---|
| 24 | 23 | | (E) construction of multi-purpose flood |
|---|
| 25 | 24 | | mitigation and drainage infrastructure projects that control, |
|---|
| 26 | 25 | | divert, capture, or impound floodwater, stormwater, agricultural |
|---|
| 27 | 26 | | runoff water, or treated wastewater effluent and treat and |
|---|
| 28 | 27 | | distribute the water for the purpose of creating an additional |
|---|
| 29 | 28 | | source of water supply. |
|---|
| 30 | 29 | | SECTION 2. This Act takes effect September 1, 2025. |
