87 AN ACT
98 relating to the projects eligible for financial assistance from the
109 flood infrastructure fund.
1110 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1211 SECTION 1. Section 15.531(2), Water Code, is amended to
1312 read as follows:
1413 (2) "Flood project" means a drainage, flood
1514 mitigation, or flood control project, including:
1615 (A) planning and design activities;
1716 (B) work to obtain regulatory approval to provide
1817 nonstructural and structural flood mitigation and drainage;
1918 (C) construction of structural flood mitigation
2019 and drainage infrastructure; [and]
2120 (D) construction and implementation of
2221 nonstructural projects, including projects that use nature-based
2322 features to protect, mitigate, or reduce flood risk; and
2423 (E) construction of multi-purpose flood
2524 mitigation and drainage infrastructure projects that control,
2625 divert, capture, or impound floodwater, stormwater, agricultural
2726 runoff water, or treated wastewater effluent and treat and
2827 distribute the water for the purpose of creating an additional
2928 source of water supply.
3029 SECTION 2. This Act takes effect September 1, 2025.
